This Catalog describes various additional services that may be ordered with your SurveyMonkey Audience purchase. These services can only be ordered in conjunction with an Order Form for sample. Any services that you order will appear on your Order Form.

Survey Design & Creation

If you have a survey that you need to re-create on an online survey platform, SurveyMonkey’s Survey Design & Creation service can help. This service allows you to send SurveyMonkey a survey comprising a set of questions and response options in a common file format (such as a Microsoft Word document). SurveyMonkey will then re-create your survey on the SurveyMonkey platform. You will also need to provide your account representative with the username of the SurveyMonkey account in which you wish the survey to be re-created.

Once we receive your complete survey, we will create it on the SurveyMonkey platform, typically within 5 business days. We’ll then let you review the survey online, and will participate in up to two phone calls with you to discuss any revisions and survey design changes you may want. Phone calls must be scheduled in advance with your SurveyMonkey account representative and must occur within 3 weeks of the survey being initially made available for your review. SurveyMonkey will incorporate agreed upon changes into the survey after each phone call.

A survey re-created in your SurveyMonkey account using this service will be governed by the terms and privacy policy applicable to that account when you registered for it.

Survey Programming

Survey Programming services help you to further customize your online surveys in various ways. For example, SurveyMonkey can incorporate additional elements into your survey such as multimedia, interactive features and advanced logic. Survey Programming services also offer the ability to run simulation surveys and perform advanced analytics on the survey data that you collect.

Contact your account representative if you are interested in learning about how the Survey Programming services that we support may be able to assist with your surveying activities. Your account representative will work with you to insert, in an Order Form, a mutually acceptable description of the nature of the Survey Programming services and any deliverables to be provided. SurveyMonkey will implement those services and program your survey accordingly. We’ll then let you review the deliverables (where applicable), and will participate in up to two phone calls with you to discuss any revisions and changes you may want. Phone calls must be scheduled in advance with your SurveyMonkey account representative and must occur within 3 weeks of the survey being initially made available for your review. SurveyMonkey will incorporate agreed upon changes after each phone call.

Survey Translation

SurveyMonkey can translate your survey questions and response options from one supported language to another supported language (or languages) of your choosing. Please contact your SurveyMonkey account representative for a list of languages that we support.

This service allows you to send SurveyMonkey a survey comprising a set of questions and response options in a common file format (such as a Microsoft Word document). SurveyMonkey will return a translated copy of the survey to you, typically within 5 business days, and you will then have 15 days to review it (or such other period that may be agreed upon) (the “Review Period”).

Unless you inform us in writing that the translated copy has errors, inaccuracies or other translation deficiencies within the Review Period, you will be deemed to have accepted the translation. SurveyMonkey will correct any deficiencies which were identified prior to the end of the Review Period.

Translated surveys will be delivered to you via a common file format (such as a Microsoft Word document). Alternatively, if you would like SurveyMonkey to create the translated survey directly on an online survey platform, you will need to also order Survey Design & Creation (for creation on the SurveyMonkey survey platform) or Survey Programming (for creation on other supported survey platforms).

Jumpstart

If you would like assistance in drafting one of your first surveys, SurveyMonkey’s Jumpstart service can help. This service provides you with experienced SurveyMonkey personnel who will draft a survey for you on the SurveyMonkey platform. Our personnel will work with you to construct your survey questions and structure, define your target audience, and then create the online survey (consisting of a maximum of 30 questions) that will assist you in achieving your desired goals.

In accordance with the terms that apply to your SurveyMonkey account in which your surveys are stored, you will retain ownership of the intellectual property rights in and to the survey created in your SurveyMonkey account. However, because SurveyMonkey will have drafted the survey questions for you, you grant us a worldwide, perpetual, irrevocable, royalty-free, transferable and sub-licensable license to use those questions and associated response options (but not any responses that you collect using that survey) for our own purposes, which may include commercial purposes, provided that we remove any references in the survey that specifically identify you (the “Jumpstart License”).

Profiled Demographic Questions

To help customers who are continually targeting particular demographics that are not profiled by SurveyMonkey Contribute, Profiled Demographic Questions provide you with the ability to have new profile questions added to the SurveyMonkey Contribute member profiler survey. The new profile questions will be presented to SurveyMonkey Contribute members who join after the profile questions are added to the member profiler survey. Because answering profile questions is voluntary, we do not guarantee any level of answer coverage across our member base after the new questions are added.

New profile questions are subject to approval by SurveyMonkey and may not be changed after they are added to the member profiler survey. We will retain the new profile questions for at least 120 days, after which SurveyMonkey may retain, modify or remove the questions at its sole discretion.

All profile questions, their associated response options, and responses from SurveyMonkey Contribute members to those questions will be owned by SurveyMonkey. Such responses may also be used by other SurveyMonkey Audience customers for survey targeting purposes.

Pricing is based upon the number of new profile questions that we agree with you to add.

Custom Survey Templates

With the Custom Survey Templates service, SurveyMonkey will assist you to create a reusable survey template. This service includes a one hour phone call to discuss your requirements for your survey. We will then create a survey template (comprising a list of questions and response options) that is delivered to you in Microsoft Word format. We allow up to two rounds of revisions on your survey template before final delivery.

You will own the intellectual property rights in the survey templates created for you using this service. However, you grant SurveyMonkey a worldwide, perpetual, irrevocable, royalty-free, transferable and sub-licensable license to use the questions and associated response options in those survey templates (but not any responses that you collect using that survey template) for our own purposes, which may include commercial purposes, provided that we remove any references in the survey that specifically identify you.

Each survey template is limited to a maximum of 35 questions and additional fees may apply if more questions are required.

Scorecards (Stat Tested Scorecards / Custom Scorecards)

Scorecards is a service that helps you to perform complex analysis of scale-based questions. We will construct scorecards, delivered in Microsoft Excel format, that consist of either: (a) up to 5 concepts scored against up to 5 metrics, with stat testing conducted on the “top 2 box”; or (b) up to 5 concepts scored against 1 metric, broken down into the different answer options for that metric, with stat testing conducted on each answer option and the “top 2 box”.

In the context of Scorecards: A “concept” is a variant of a thing you wish to evaluate. A “metric” is an attribute associated with a concept. An “answer option” is one option on a scale of answer options associated with a metric. “Top 2 box” refers to the aggregate score of the two answer options that scored the highest in relation to a metric. Stat testing in scorecards include a z-test against a set of answer options.

Inclusion of additional metrics will require additional scorecards. The source data for scorecards must be sourced directly from the SurveyMonkey survey platform. Additional costs apply for data sourced from other sources such as SPSS.

Survey Data Merge

A Survey Data Merge helps you to merge the results of multiple similar surveys into a single data file to assist with results analysis. We will merge the survey data from up to three similar surveys conducted on the SurveyMonkey survey platform into one Microsoft Excel file.

Pricing is based on the number of questions in your surveys. We may also be able to merge survey data from more than three surveys at additional cost – please contact us for details.

Onsite Training

Our Onsite Training service provides training to your employees so they can learn about the SurveyMonkey Audience family of services. We will send one member of our training team to one of your offices to deliver in-person training.

Onsite Training is not available in all geographic locations and is subject to the availability of our training staff. We will be happy to provide more details upon request.

Pricing is based on the number of days of Onsite Training you require. Onsite Training is available in one-day increments. Travel and lodging costs are additional fees that will be charged to you at the completion of the training. Additional fees may be payable if travel outside of the United States is required. Additional fees are payable if multiple trainers are required.

Common Terms and Conditions

The following terms and conditions apply to all Services described in this Catalog:

Interpretation. Capitalized but undefined terms in this Catalog have the meanings ascribed to them in the applicable Order Form or other document which has incorporated this Catalog by reference. In this Catalog, “we”, “our” and “us” refers to SurveyMonkey and “you” and “your” refers to you, the Customer.

Subcontracting.
Customer acknowledges and accepts that SurveyMonkey may in its sole discretion delegate or subcontract the provision of these Services (or parts thereof) to third parties without the notice or consent of Customer. Notwithstanding the foregoing, SurveyMonkey shall remain responsible to Customer for all performance under this Agreement.

DISCLAIMER OF WARRANTIES. TO THE EXTENT PERMITTED BY APPLICABLE LAW, AND EXCEPT AS EXPRESSLY PROVIDED HEREIN, ALL SERVICES IN THIS CATALOG ARE PROVIDED “AS IS” WITH ALL FAULTS, WITHOUT ANY WARRANTY OF ANY KIND, AND SURVEYMONKEY DISCLAIMS ALL IMPLIED OR STATUTORY WARRANTIES REGARDING SUCH SERVICES, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT OF THIRD PARTY RIGHTS.

Indemnity. Customer agrees to defend, indemnify, and hold SurveyMonkey, its Affiliates and their employees, directors, officers, contractors and agents (collectively, the “SurveyMonkey Indemnified Parties”) harmless from and against any and all liabilities, damages, claims, suits, judgments, costs, losses or expenses (including but not limited to, reasonable attorneys’ fees) alleged by a third party and suffered or incurred by any SurveyMonkey Indemnified Party arising out of or related to an allegation that the materials Customer provided for use by SurveyMonkey in connection with the Services described in this Catalog infringe or impair such third party’s intellectual property rights.
