You can review a summary of our revised terms and policies below. While we've highlighted the changes that we think are the most relevant to our users, we recommend you review the full documents.  

Updates to Terms of Use ("TOU")

  • We have added clarifying language around the use of third party services; if you use or connect another service on or to SurveyMonkey, what happens is between you and them.
  • We have added language to allow you to take part in early preview or beta programs that we may offer from time to time.
  • We have added language clarifying the availability of our services in certain regions to reflect changes in our internal company policy and to maintain compliance with applicable export regulations.
  • We have added clarifying language which prohibits your use of our platform in a way that breaches data protection laws, or requires compliance with laws not listed in our terms.

We have added more details in our Privacy Notice around the purposes for which we process your personal data, and the legal bases that we rely on. For example:

  • We have added ‘providing customer support’, ‘usage information to ensure we meet our SLAs’, ‘integration data’, and ‘aggregated or de-identified survey questions and responses’ to ‘contract’, as these data elements are necessary to provide our services to our customers. 
  • We have clarified how we use machine learning as part of our fulfillment of our contractual obligations to you. We are not changing how we handle data and you can read more about how we harness machine learning for the services in Section 3.2 of our Privacy Notice and in our feature linked Help Center articles here and here.
  • We have clarified that we use ‘event (log) data’ and ‘aggregated or de-identified survey questions and response’ to enforce our agreements, monitor for abuse, and investigate security issues. 

In our Data Processing Agreement, we have clarified the definition of ‘Data Protection Legislation’ to refer to legislation that applies to SurveyMonkey as a processor. 

In our EU Data Transfer Statement, we have updated the page to remove references to the Privacy Shield and added references to the new Data Privacy Framework.  

Updates for our Rewards Panelists 

For services provided by SurveyMonkey Inc., we have modified the personal jurisdiction and venue to federal and state courts located in San Francisco, California. 

Other things to note:

  • Except as outlined above, all changes will go into effect on December 31, 2023 for any existing users who have accounts with us prior to November 1, 2023.
  • We also maintain archived versions of our key policies for your reference.
