WEDI No Surprises Act TG Survey: Evaluating Successes and Obstacles of Implementation and Operation of the Good Faith Estimate for Uninsured and Self-Pay Patients

INTRODUCTION
The Workgroup for Electronic Data Interchange (WEDI) is conducting this survey to better understand how health care providers are implementing the Good Faith Estimate (GFE) uninsured and self-pay requirements under the federal No Surprises Act (NSA). These regulations, which went into effect on January 1, 2022, by the Centers for Medicare & Medicaid Services (CMS), require providers to issue GFEs to all patients who are paying for services out-of-pocket either upon request or upon scheduling of the service. GFEs must be delivered via email or hard copy and include specific data elements, though CMS has not mandated a specific format. An example format is available at Good Faith Estimate Instructions. Note that any state-level legislation regarding cost estimates must still be met while also complying with the federal NSA.

WEDI is a multistakeholder, non-profit organization named in the Health Insurance Portability and Accountability Act as an advisor to the Department of Health and Human Services. DEFINITIONS:
The following are definitions of terms used in this survey.

An estimate is a calculation of cost expected for items or services that have not yet been provided.

Good Faith Estimate (GFE) is an estimate that complies or intends to comply with the legislative format and content requirements as defined in the No Surprises Act. The Good Faith Estimate requirements in the NSA differ from the Hospital Price Transparency rules that apply to hospital websites.
