Program Information

Purpose

The purpose of the NDPA Layers of Protection Program is to identify products that can help prevent drowning and to provide a consumer recommendation for products meeting a high level of reliability and excellence in the aquatic environment. This recommendation is a message to consumers that they are using a product that has met the accepted level of certification, testing, and reliability from a manufacturer that believes in drowning prevention and water safety. This is not an endorsement of a product, rather is a recommendation to the consumer.
Qualification & Specific Levels

 
Qualification: NPDA will use a qualification process to identify complying companies who are manufacturing safety products as follows:
  1. Selected companies must have been in business for at least 2 years.
  2. Selected companies must have been producing a safety product and offering for sale for at least 2 years
  3. The safety product must have been tested and approved under a nationally recognized Standard by an authorized third party testing lab. 
  4. The selected product must be designed to help prevent childhood drowning and in the opinion of NDPA effective in doing so.


Levels:  Selected qualified companies and their products can participate in NDPA’s incentive program. This program will have three levels and they are as follows:
  1. LEVEL ONE: Qualified products can use the NDPA Layers of Protection Logo for a period of one year. Qualified companies can market their product as being effective in the prevention of childhood drowning and has been recognized by NDPA as doing so. The license for using the NDPA Layers of Protection Logo will be for a period of one year for a contribution of $5000.00
  2. LEVEL TWO:  Qualified products can use the NDPA Layers of Protection Logo for a period of one year. Qualified companies can market their product as being effective in the prevention of childhood drowning and has been recognized by NDPA as doing so. The qualified product and company will be featured on the NDPA website and marketing material. The license for using the NDPA Layers of Protection Logo will be for a period of one year for a contribution of $10,000.00
  3. LEVEL THREE: Qualified products can use the NDPA Layers of Protection Logo for a period of one year. Qualified companies can market their product as being effective in the prevention of childhood drowning and has been recognized by NDPA as doing so. The qualified product and company will be featured on the NDPA website and marketing material. They also will be featured at the NDPA Conference, allowed to market their product to the conference and will be given the opportunity to address the conference. The license for using the NDPA Layers of Protection Logo will be for a period of one year and will be exclusive for that product line for a contribution of $15,000.00
Application & Review Process

Application: This application will ask detailed questions about the product including its purpose, length of time on the market, product testing results, and any additional information. The application will also ask for information on the manufacturer’s background, length of time in the industry, and other applicable information. An application fee is required for each application submitted at the cost of $100 per application. Once your application has been submitted for review, the NDPA Executive Director will be in touch with you to collect the application fee and any missing information.

Review of Application: Once an application has been submitted for review, the NDPA Layers of Protection Evaluation Committee will hold a meeting to discuss the product, manufacturer, and application. The committee will review all information submitted from the manufacturer as well as conduct its own research into the product category and manufacturer. This research will include investigating any applicable codes, standards, testing requirements, product recalls, etc. The committee will then evaluate the product information submitted for review against the research findings. Based on the committee’s findings, the committee chair will make a recommendation to the NDPA Board of Directors on whether the product should receive the Layers of Protection Recommendation Seal.  Please allow up to 45 days for the review process and consideration by the NDPA Board of Directors.

Notification: The NDPA Executive Director will notify the applicant of their results within 5 business days of the board meeting which their application was reviewed. If the application was approved, the Executive Director will work in conjunction with the committee chair and the NDPA Legal Counsel to draft the contract and applicable documents. If the product was denied the recommendation, the Executive Director will inform the applicant of the decision and explain the rational for the decision. An applicant may choose to appeal this denial by re-submitting a new application that addresses either the NDPA Product Evaluation Committee or the NDPA Board of Director’s concerns. This re-submitted application will follow the same procedures as a brand-new application. The applicant will be required to pay an additional application fee. If the application is denied for a second time, the applicant will not be eligible to re-submit a new application for a period of 1 calendar year from the day the denial is issues by the NDPA Board of Directors.

Contract & Payment: The NDPA Executive Director will deliver the contract to an applicant receiving majority support. The generic contract will be drafted by the NDPA Legal Counsel. The contract will be valid for 1-year and can be considered for renewal each year. Each approved product will be reconsidered by the committee and the NDPA Board of Directors every 2 years for continued support. The agreed upon payment must be made to the NDPA before any labeling, advertisements, press releases, and website mentions are given. Continuing payments must be made to the NDPA at the time of contract renewal each year.

NDPA Website: The NDPA Website will contain a specific page for this program. The website will have information on all recommended products and links to their manufacturer and point of sale. Data related to this page will be delivered on an annual basis to the applicant.
