2022-23 Participation Benefits and Release of Liability

Read Before Signing

In consideration of being allowed to participate in any way in the programs of Columbus Curling Club, Inc. (“Club”) and the United States Curling Association, Inc. (“USCA”), their related events and activities, the undersigned, acknowledges, appreciates, and agrees that:

• The risk of injury from the activities involved in this program is significant, including the potential for permanent paralysis and death, and while particular skills, equipment, and personal discipline may reduce this risk, the risk of serious injury does exist; and

• Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people. The Club has put in place preventative measures to reduce the spread of COVID-19; however, the Club cannot guarantee that you will not become infected with COVID-19. Further, participating in or attending any game, event, program, or activity at the Club could increase your risk of contracting COVID-19. By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that I may be exposed to or infected by COVID-19 while attending the Club and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at the Club may result from the actions, omissions, or negligence of myself and/or others, including, but not limited to, Club members, volunteers, program participants, and their families. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any and all claims including, but not limited to, injury to myself (including, but not limited to, personal injury, illness, disability, or death), damage, loss, claim, liability, legal expenses, court costs, or expense, of any kind, that I may experience or incur in connection with my attendance at the Club (“Claims”). Additionally, I hereby release, discharge, hold harmless and covenant not to sue the Club, its agents, and representatives, of and from the Claims, including any and all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any claims based on the actions, omissions, or negligence of the Club, its agents, and representatives, whether a COVID-19 infection occurs before, during, or after participating in or attending any Club game, event, program or activity.

• I knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of the Releasees or others, and assume full responsibility for my participation; and

• I willingly agree to comply with the stated and customary terms and conditions for participation. If, however, I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the Club and the USCA immediately; and

• The consumption of alcohol at the Columbus Curling Club is optional and a personal decision. I agree to drink responsibly. I acknowledge that I alone am responsible for all my actions resulting from consuming alcohol and the Club is in no way responsible. Persons under the age of 21 are not to purchase or consume alcohol at any time while on the premises of the Columbus Curling Club; and

• I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, hereby release the Club, the USCA, and any club, team or other organization that is a member in good standing of the USCA at whose facilities I engage in any curling activity, including, but not limited to practices, clinics, exhibitions, games or tournaments, their officers, officials, agents and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and, if applicable, owners and lessors of premises used for the activity (“Releasees”), with respect to any and all injury, disability, death, or loss or damage to person or property associated with my presence or participation, whether arising from the negligence of the Releasees or otherwise, to the fullest extent permitted by law.

• I understand that, as a participant in an outing, bonspiel, or one-time event and by signing this release form, I am awarded the status of temporary member of the Columbus Curling Club. This entitles me to enjoy the use of the club facilities for the duration of this event and subsequent 2022-23 events I attend.

I, the undersigned parent or legal guardian, have read the above waiver and release and agree to its terms on behalf of my child and myself. I understand that by signing below I am giving up substantial right on behalf of my child and myself.

I have been provided a copy of the Youth Sports Organization Concussion Information Sheet as required under Ohio’s return to play law.
