This guided hike will allow you to challenge yourself with a hike with support and confidence of having trained / certified mountain guides with you. This contest is open to those living in the greater Seattle, Washington area and starts on June 1, 2024 ending June 9, 2024. 10 lucky winners will be selected randomly from the completed forms and contacted via email on or after June 10, 2024. Winners must arrange their own transportation for the hike, in addition to providing their own equipment, accommodation and meals.

HELLY HANSEN GUIDED HIKE GIVEAWAY TERMS AND CONDITIONS

VIEW EVENT DETAILS

These Terms and Conditions govern Helly Hansen’s Guided Hike Giveaway in partnership with Mountain Madness (the “Contest”). All other information provided prior to entering the Contest including, without limitation, all information provided by Helly Hansen directly to participants/winners or published by Helly Hansen on its own website, or via any other media channel (including social media outlets) form part of these Terms and Conditions.

TERMS OF ENTRY

1. The Contest shall open for entry at 00:01 PDT on June 1, 2024 (the “Opening Date”) and close at 23:59 PDT on June 9, 2024 (the “Closing Date”).
2. Entry is open to any person of any nationality aged 18 or over as at the Closing Date who:
a. has a moderate level of fitness;
b. is available to attend the Guided Hike in Snoqualmie, Washington June 21, 2024 (the “Hike”).;
c. has some experience of alpine activities, backcountry etiquette and is reasonably prepared (including access to reasonable kit including but not limited to a, backpack, hiking shoes, appropriate clothing, anticipating alpine weather and conditions which may be changeable);
d. is socially active on Facebook, Twitter, Tik Tok and/or Instagram; and
e. does not have any other clothing sponsorship deals, arrangements or otherwise be affiliated with any competitor of Helly Hansen.
3. Entry instructions are as communicated by Helly Hansen on its social media/website pages and posts relating to the Guided Hike. Any entries that are incomplete will not be valid and deemed void.
4. Any entries received by Helly Hansen after the Closing Date will not be considered in any circumstances.
5. The Winner(s) of the Contest shall be chosen by Helly Hansen in its sole discretion, on or after the 10 June 2024. The Hike and any associated benefits are non-transferable.
6. Helly Hansen will attempt to contact the Winner(s) via direct email. If no response is received by 23:59 PDT on 14 June 2024, or if the Winner(s) does not provide Helly Hansen with any information, details or consents which are reasonably required prior to the Hike (which may include provision of confirmation of travel/accommodation arrangements), Helly Hansen reserves the right to offer the Hike to another entrant.

THE PRIZE AND LIMITATIONS
7. The winner shall be entitled to one spot on the Hike, which may include some or all of the following activities (at the sole discretion of Helly Hansen): Hiking, backcountry travel, skiing or snowboarding, avalanche training, and education on avalanche safety,
8. The Hike is scheduled to take place on June 21, 2024. Notwithstanding the foregoing, by entering the Contest, all Participants acknowledge and accept that the Hike may be cancelled at short notice due to weather conditions.
9. Helly Hansen shall cover the following costs in relation to the Hike: all costs of the Hike itself. For the avoidance of doubt, this shall not include accommodation, travel, equipment or food costs.

EXPECTATIONS AND OBLIGATIONS OF THE WINNER(S)/PARTICIPANTS
11. By entering the Contest and taking part in the Hike, the Participants acknowledge that this is a backcountry, physical and outdoor alpine event and, as such, each Participant agrees that:
a. there are certain, unavoidable personal and safety risks involved, which Helly Hansen takes no responsibility or liability for in its capacity as organiser of the Contest and the Hike; and
b. Helly Hansen is not qualified to decide whether each Participant is fit to safely participate in the Hike so, if in doubt, each Participant must obtain professional or specialist advice from a doctor prior to entry in the Contest; and
c. participation in the Hike is entirely at each Participant’s risk.
12. To prepare and mitigate against such risks, each Participant agrees (by taking part in the Hike) to comply with the rules set out below before, during and following its participation in the Event and the Contest:
a. Each Participant must act responsibly and sensibly at all times and in accordance with backcountry etiquette and safety restrictions (either requested by Helly Hansen or by Mountain Madness guides and/or authorities);
b. Each Participant must acknowledge and respect the group guide and adhere to all guidelines, rules, stipulations or advice provided by the group guide;
c. Each Participant must attend and observe any and all safety briefings;
d. No Participant may take part if under the influence of alcohol or non-prescription drugs;
e. Each Participant must bring and wear/use appropriate clothing, footwear and kit (including backcountry equipment, sun cream and sunglasses).

VARIATION
13. Helly Hansen reserves the right to vary, suspend, postpone or terminate the Contest and the Hike, or any aspect thereof, for any reason(s) whatsoever and without notice. In such circumstances, the entrant hereby waives any rights or expectations which the entrant may have against Helly Hansen or any of its affiliates and acknowledges that he/she will not have any recourse or claim of any nature against Helly Hansen or any of its affiliates in respect of non-performance of the Contest terms or otherwise.

LIABILITY
14. As far as permitted by law, Helly Hansen, Mountain Madness and their affiliates shall not be liable for any loss, damage, disappointment or expense suffered or incurred by any entrant in relation to the Contest, participation in the Hike including as a result of the Hike being cancelled.

INTELLECTUAL PROPERTY RIGHTS, DATA PROTECTION AND PRIVACY
15. By entering the Contest, each entrant and Participant acknowledges and agrees that neither the Helly Hansen, Mountain Madness, nor their respective directors, officers, employees, representatives, agents, affiliates, prize suppliers, advertising and promotion agencies (collectively, the “Releasees”) shall be excluded from any liability whatsoever for any claims, costs, injuries, losses, liability or damages of any kind arising out of or in connection with (i) participation in the Contest, the Event or any related activity, or (ii) the acceptance, possession, use or misuse of the Prize or any component thereof, (including, without limitation, those related to personal injuries, death, damage to, loss or destruction of property, rights of publici

INTELLECTUAL PROPERTY RIGHTS, DATA PROTECTION AND PRIVACY
16. Each entrant agrees to the use of his/her image globally in any Helly Hansen or Mountain Madness publicity material including but not exclusive to PR, in-store, online, commercial, and social media. Each Winner agrees to their name (and the name of their guests) being publicised by Helly Hansen as required (in Helly Hansen’s sole discretion, for any purpose).
17. Any personal data relating to any entrants or Winner(s) will be used solely in accordance with data protection legislation in the State of New York.
18. By entering the Contest, you will be providing information to both Helly Hansen and Mountain Madness. Any personal data which we collect from you, or that you provide to us, will be processed by us in accordance with our Privacy Policies which can be found on our websites (http://www.hellyhansen.com/privacy-policy and https://mountainmadness.com/policies/privacy-policy).
19. We will use your data to notify you if you win the Contest, if we are otherwise required to contact you in relation to the Contest and for the purpose of arranging the Hike and future marketing and promotional purposes. Your information will not be shared with any other third parties outside of Helly Hansen, Mountain Madness, our affiliates and our respective PR agencies.

GENERAL
20. By submitting an entry, an entrant and each Winner will be deemed to have accepted and be bound by these Terms and Conditions.
21. By agreeing to take part with the Winner, it is expected that the Winner will share a copy of these terms and conditions with its guest and, by participating in the Hike with the Winner, each guest shall be deemed to have accepted and be bound by the Terms and Conditions pertaining to the Hike activities.
22. The sponsor of this Contest is Helly Hansen AS, a subsidiary of the Canadian retail chain Canadian Tire Limited, with registered office address as Munkedamsvelen 35, 6flr, N-0250 Oslo (“Sponsor”). This Contest is in no way sponsored, endorsed or administered by, or associated with, Facebook, Twitter, Instagram or any other social network.

GOVERNING LAW AND JURISDICTION
23. These Terms and Conditions and any dispute or claim arising out of or in connection with them or their subject matter (including the Contest), existence, negotiation, validity, termination or enforceability (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the State of New York.
24. The Courts of the State of New York shall have exclusive jurisdiction in relation to any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter, existence, negotiation, validity, termination or enforceability (including non-contractual disputes or claims).
