MyNetball User Agreement

Question Title

* 1. Intention of use

MyNetball is a technology platform designed to register participants and better manage competitions.

The personal information collected and stored within MyNetball must be used for the primary purpose, (specific to the Association, Division, Club, Recreation Centre or School the User belongs to) for which it was collected and in accordance with this Agreement.

* 2. Terms

1. You (the User) agree to the terms and conditions set out in this Agreement as a condition of access to MyNetball.

2. This Agreement will commence once submitted. It will remain ongoing until the earlier of:
(a) the following 31 March (after commencement);
(b) the User no longer requires to access MyNetball; or
(c) termination pursuant to these terms and condition.

3. Netball SA (NSA) reserves the right to terminate or suspend this Agreement if the User fails to comply with the terms and conditions set out in this Agreement.

4. All Users must have a current Working with Children Check or DHS/DCSI child-related employment check for the entire term of this Agreement.

* 3. Obligations

5. The User must be at least 14 years of age.

6. The User agrees to:
(a) Comply with all directions provided by NSA;
(b) Comply with NSA’s policies and procedures (including NSA’s Member Protection Policy), as amended from time to time;
(c) Comply with both Netball Australia and NSA’s Privacy Policies;
(d) Not to disclose User login details, including identifiers and passwords, to any other person or entity, or allow any other person to share login details for access to MyNetball;
(e) Ensure that MyNetball is only used for its intended purpose in accordance with this Agreement and the User's specified role, and for no other purpose;
(f) Ensure that information which is displayed on the Association or Club website or social media either now or in the future is not defamatory, libelous, slanderous, obscene, violent, indecent, abusive, threatening, harassing or otherwise capable of being deemed inappropriate. NSA, at its discretion, reserves the right to require the removal of any images or messages containing information which it deems to be any of the above;
(g) Be aware that NSA will not be responsible for any content posted by any User and that the content of the messages, whether expressed as opinions, statements or recommendations are your own and not those of NSA.

* 4. Procedures and Training

7. NSA will endeavor to provide training and helpdesk support as far as practicable on the relevant MyNetball modules within normal office hours. The medium, timing and format of the training will be determined by NSA.

* 5. Confidential Information

8. The User agrees to:
(a) At no time during the term of this Agreement, or after its termination or expiry, disclose to any person Confidential Information which is obtained from MyNetball or as a result of this Agreement;
(b) Ensure that Confidential Information shall not be left in unsecure locations or positions;
(c) Ensure that all Confidential Information (in hard copy form) is kept in locked files/draws;
(d) Ensure that Confidential Information (in hard copy form) is shredded and electronic files deleted when their usefulness has passed;
(e) Promptly inform NSA in the event of a known or suspected data breach or data loss as per Privacy Amendment (Notifiable Data Breaches) Act 2017.

9. For the purpose of this Agreement "Confidential Information" includes all data (in any form) in relation to a member or members, where that data is collected, used, disseminated or copied for the purpose of MyNetball.

I understand a breach of clause 8 may result in immediate termination of this agreement.

* 6. Liability and Indemnity

10. The User agrees to:
(a) NSA and Netball Australia are not liable for injury or damage suffered or incurred by any person or to any property, as a result of any breach of this agreement; and
(b) The User will indemnify and keep NSA and Netball Australia indemnified in respect to all claims, demands, proceedings, judgements, damages, fines, penalties, costs, expenses or losses, which Netball Australia or NSA may suffer or incur, as a result of any breach of this Agreement.

11. NSA makes no warranties whatsoever in relation to the continuation of MyNetball, the ability to access MyNetball modules or the continuing availability of MyNetball modules.

* 7. Termination

13. Either party may terminate this Agreement by giving the other party not less than thirty (30) days' notice in writing. In addition, NSA may terminate this Agreement without notice to the User if:
(a) the User or the User’s Member Organisation fails to comply with the terms of this Agreement and fails to remedy such breach after reasonable notice from NSA; or
(b) the User is no longer a member of the Member Organisation; or
(c) the Member Organisation is no longer affiliated with NSA; or
(d) the Member Organisation is wound up and therefore is no longer affiliated with NSA.

14. Upon termination the User must return to NSA, all property belonging to NSA, including but not limited to, all documents and electronic material in relation to or created as a result of the use of MyNetball. The User must confirm that all Confidential Information extracted from MyNetball will be securely destroyed, in whatever form.

* 8. Miscellaneous

15. This Agreement may be varied only by agreement in writing between the parties.

16. This document records the entire Agreement between the parties as to its subject matter and replaces any previous written or oral agreements or understandings between the parties.

17. This agreement is governed by the law in force in South Australia. Each party submits to the jurisdiction of the courts of South Australia.
