This tool allows Long-Term Care (LTC) providers to report inconsistencies in how Long-Term Care Regulation (LTCR) survey staff interpret and apply the regulations. HHSC uses this data to guide and enhance training, consistency, and improve policies and procedures.

So that LTCR staff may research the issue thoroughly, please provide identifying information regarding the LTC provider, facility or agency and the survey date and deficiencies and/or violations issued.  Quality Assurance staff do not share identifying information with the regional survey staff while investigating the inconsistency.

Examples of inconsistencies you might report using this tool include:

1)  Inconsistencies between surveyors (such as when one surveyor identifies a violation, but a different surveyor on a different occasion does not find the same situation as a violation);

2)  Inconsistencies across regions (such as when a provider has been cited for a rule violation in one part of the state, but surveyors in a different region do not cite another provider for the same situation);

3)  Inconsistencies over time (such as when a surveyor’s interpretation of a violation changes between visits).

The intent of this effort is not to modify survey protocol or tags; it is strictly to identify issues in survey consistency as an informational and improvement tool.  HHSC will not notify individual informants of specific research findings, but will release a statistical report to inform providers of consistency analysis and any actions related to those findings.
