YOU MUST SUBMIT PROOF OF VACCINATIONS IN THIS FORM FOR YOUR DOG.

IF YOU ARE BRINGING MULTIPLE DOGS, PLEASE SUBMIT A SEPARATE FORM FOR EACH DOG.


Bring your Dog if he/she:
• Is old enough to be around other dogs and people (at least 6 months of age)
• Is up to date on all required vaccinations (Rabies, DHPP, Bordetella)
• Is in good health
• Behaves well on-leash and is not aggressive toward other dogs
• Is friendly toward humans and not excessively fearful

Don't bring your Dog if he/she:
• Is still too young to interact with other dogs or a big crowd (under 6 months)
• Does not respond well to large crowds and loud noises
• Has aggressive tendencies towards other dogs or humans while on-leash (or off)
• Is exhibiting any signs of illness prior to the Event (e.g., cough, nasal discharge, diarrhea, etc.). These symptoms can be a sign of potentially infectious illness. It would be best for your dog as well as the other dogs in attendance, if your dog does not attend the Event if he or she is exhibiting any signs of illness.

If you have a dog that is an aggressive breed, or with aggressive tendencies, you should STRONGLY consider not bringing it to the Event. We reserve the right to refuse entry to any dog or request a dog who has expressed aggression to leave the Event without a refund. Older dogs, dogs with short muzzles, and/or dogs in general that are prone to heat exhaustion should consider not attending the Event. Direct sun and heat can be a deadly combination for dogs. Dogs cool themselves by panting and are not nearly as efficient as us humans. Please keep the comfort and safety of your dog at the forefront of your mind.

We reserve the right to deny any dog or human entry to the Event for any reason. Participants are expected to practice responsible pet ownership. Do not bring your dog if it exhibits aggressive or unpredictable behavior in crowds, with other dogs, and/or with strangers. Do not bring a female dog in heat. Any participating dog must be at least 6 months old. Use good judgment regarding the temperament of your pet so that the Event will be enjoyable for everyone.
GENERAL RELEASE AND WAIVER OF LIABILITY


PLEASE READ THIS GENERAL RELEASE AND WAIVER OF LIABILITY (THIS “RELEASE”) CAREFULLY BEFORE AGREEING TO ITS TERMS. THIS RELEASE HAS LEGAL CONSEQUENCES AND AFFECTS PARTICIPANT’S (AS DEFINED BELOW) LEGAL RIGHTS AND MAY ELIMINATE PARTICIPANT'S ABILITY TO BRING FUTURE LEGAL ACTIONS. THIS RELEASE EXPRESSLY INCLUDES A RELEASE OF CLAIMS (AS DEFINED BELOW) OR POTENTIAL CLAIMS THAT HAVE ARISEN OR MAY ARISE IN THE FUTURE IN WHOLE OR IN PART FROM THE NEGLIGENCE OF THE RELEASED PERSONS (AS DEFINED BELOW). PARTICIPANT ACKNOWLEDGES AND AGREES THAT THE EFFECT OF THIS RELEASE IS TO WAIVE ALL CLAIMS AGAINST AND RELEASE THE RELEASED PERSONS FOR THE RELEASED PERSONS’ OWN PAST AND FUTURE NEGLIGENCE, AND FOR STRICT LIABILITY, INCLUDING, WITHOUT LIMITATION, STRICT PRODUCTS LIABILITY, TO THE FULLEST EXTENT PERMITTED BY THE APPLICABLE LAW.


In consideration of participating in the “Pups at the Pitch” event during the Houston Dash match at Shell Energy Stadium (the “Event”), the undersigned (the “Participant”), and if such individual is under 18 years of age, then also the parent or legal guardian of such minor Participant on his or her behalf and the parent/legal guardian’s behalf (who shall also be considered a Participant for purposes of this Release), agree to the following:
1. To the fullest extent permitted by law, Participant hereby knowingly, voluntarily, unconditionally, irrevocably, and forever releases, waives, and discharges Dash Soccer, LLC, Dynamo Stadium, LLC, National Women’s Soccer League, LLC (“NWSL”), City of Houston, Harris County, Harris County Houston Sports Authority, and each of their respective affiliates, partners, commercial sponsors, assignees, successors, officers, directors, agents, representatives, administrators, employees, contractors, subcontractors, all employees of contractors and subcontractors, shareholders, members, administrators, designees, licensees, clubs, invitees, volunteers, all owners or lessors of premises used in connection with the Event and other personnel (collectively, the “Released Persons”) from any and all present and future claims, suits, actions, causes of action, liabilities, demands, damages, losses, judgments, debts, dues, payments, sums of money, liens, executions, responsibilities and accounts, and any other expenses (including, but not limited to, attorneys’ fees and court costs), of any nature whatsoever, including in law or equity, contingent or non-contingent, known or unknown, suspected or unsuspected, foreseen or unforeseen, matured or unmatured, accrued or unaccrued, asserted or unasserted, liquidated or unliquidated, whether past, present, or future, in any way relating to or arising from Participant’s participation in the Event (collectively “Claims”) that Participant or his/her child or ward, parent or legal guardian, family, estate, heirs, representatives, executors, insurers, administrators, successors or assigns (collectively, “Related Parties”) may have. Claims may include or arise out of: (i) the negligence or carelessness, whether active or passive, of one or more of the Released Persons; (ii) personal injury, illness, or death to any person or animal; (iii) damage to, or loss or theft of, property (including, but not limited to, personal items, cars, animals, and money); (iv) the receipt of medical care or treatment for any physical or mental condition by Participant or Participant’s dog(s) (which shall be at Participant’s sole cost); (v) use of facilities, services, premises, and equipment; (vi) exposure to inclement weather and/or any disease; (vii) involvement in accidents of any kind; and (viii) the Rights by the Released Persons, including any defamation (including libel and slander), invasion of privacy, right of publicity, copyright infringement, or any other personal or property rights from or related to any exploitation of the Rights. Participant voluntarily and knowingly assumes all of the risks arising out of participating in the Event and accepts personal responsibility for any and all Claims.
2. Participant agrees to indemnify, defend and hold the Released Persons harmless from any Claim incurred by a Released Person or brought against a Released Person by a third party, including those arising from, relating to, or in connection with (i) the Event or any other activities for which Participant has acknowledged and assumed risk under this Release, (ii) Participant’s or any Related Parties’ negligence, omission or willful misconduct, or (iii) any and all acts or behavior of Participant’s dog(s).
3. Participant understands, agrees, acknowledges and accepts that (i) this Release is intended to be binding on Participant and the Related Parties; (ii) participation in the Event involves certain inherent risks and dangers that may result in accidents, property loss or damage, bodily injury, disability, or death regardless of the care and precautions taken by the Released Persons, and may include contact or collision with persons, animals or objects, inadequate or negligent first aid and/or emergency measures, weather-related hazards, natural hazards, and certain other risks not known to Participant which are not reasonably foreseeable at this time; (iii) Participant is voluntarily signing this Release and participating in the Event with full knowledge of the risks involved and accepts all risks of participation, known and unknown; (iv) participation does not constitute a condition or requirement of employment with any of the Released Persons; (v) Participant shall not be entitled to any compensation for his or her appearance at the Event or the Released Persons’ subsequent exploitation of the Rights; (vi) Participant has and will refrain from any offensive or distasteful remarks or conduct and will conduct him or herself in a courteous and professional manner at all times during his or her participation at the Event; (vii) this Release is intended to be as broad and inclusive as permitted by applicable law; and (viii) Participant has been provided, has read, and will maintain strict adherence to the Event safety and security protocols. Participant understands and acknowledges that any of these risks, and others not specifically listed here, could cause injuries that may be minor (for example, scrapes, dog bites, bruises, sprains, nausea, cuts), serious (for example, property loss or damage, broken bones, fractures, dog fights), or catastrophic (for example, rare occurrences of permanent disabilities or death, and loss of income and/or career opportunities). These risks may result from Participant’s own actions or inactions, as well as the actions or inactions of others, the rules of play, and the condition of the facilities and equipment.
4. Participant understands, acknowledges and agrees to comply with the rules set forth on Exhibit A, attached hereto.
5. Participant authorizes the Released Persons and any licensed health care provider designated by any of the Released Persons to provide medical treatment to Participant, should the need arise. Participant understands that this authorization is given in advance of any specific diagnosis, treatment or hospital care, and that it is given to provide the Released Persons and any licensed health care provider designated by any of the Released Persons with authority to seek medical treatment as they judge necessary for Participant. Participant further agrees to pay all costs associated with such medical treatment and to indemnify, defend and hold harmless the Released Persons from any Claims arising from such medical treatment. Participant understands, acknowledges and accepts that any medical attention he or she should need or require as a result of his or her participation in the Event will be fully covered by Participant and/or through his or her personal insurance policies. Released Persons will not provide any such insurance for Participant’s benefit.
6. Participant consents to be recorded, photographed, and videotaped related to the Event, and hereby irrevocably and perpetually authorizes any of the Released Persons to copyright and make derivative works from, publish, reproduce, exhibit, transmit, broadcast, televise, license, digitize, display, use, and/or permit others to use (i) Participant’s name, image, biographical information, likeness, and voice, and (ii) all photographs, recordings, videotapes, audiovisual materials, depictions, writings, statements, and quotations of or by Participant related to the Event (collectively, the “Materials”), in any manner, form, or format whatsoever now or hereinafter created, including, but not limited to, on the Internet and in social media, and for any lawful purpose without payment to Participant or consent beyond this Release, including, the advertisement or promotion of the Released Persons and/or the Event (the “Rights”). Participant understands that the Released Persons are under no obligation to use the Materials. Participant agrees all statements made by Participant in the Materials will be true and correct, and that all of the Materials, and all films, audiotapes, videotapes, reproductions, media, plates, negatives, photocopies, and electronic and digital copies of the Materials are the property of the Houston Dash and NWSL. Participant further agrees not to contest the rights or authority granted to the Released Persons hereunder. Participant hereby waives any moral rights to the Materials and right to inspect, edit or otherwise approve the Materials, and modes of the use thereof as described above.
7. Participant understands the terms of this Release including that Participant is hereby giving up substantial legal rights, and further agrees that no oral representations, statements or inducement contrary to anything contained herein have been made by the Houston Dash or any of the other Released Persons. Participant expressly agrees that this Release is governed by the laws of the State of Texas, without regard to conflict of law principles. Participant further agrees that if any portion of this Release is invalid, the remainder will continue in full legal force and effect. In the event of any dispute or controversy, Participant agrees to engage in good faith efforts to mediate such dispute or controversy within 30 days. Any agreement reached will be formalized by a written contractual agreement at that time. Should the issue not be resolved by mediation within the 30-day period, Participant agrees that all disputes or controversies arising out of his or her participation in the Event shall be submitted to binding arbitration in accordance with the applicable rules of the American Arbitration Association then in effect and held in Houston, Texas. The cost of arbitration shall be shared equally by the parties. Participant agrees that any arbitration or mediation shall proceed solely on an individual basis without the right for any dispute to be arbitrated on a class action basis or in a purported representative capacity on behalf of others. Claims may not be joined or consolidated unless agreed to in writing by all parties.
IF PARTICIPANT IS UNDER 18 YEARS OLD, THIS FORM MUST BE READ AND SIGNED BY PARTICIPANT'S PARENT OR LEGAL GUARDIAN:

I represent and warrant that I am the parent or legal guardian of the above-named Participant, and I agree that Participant may participate in the Event. On behalf of Participant, I hereby irrevocably and unconditionally (i) agree to all of the terms of this Release, and (ii) authorize the Released Persons and any licensed health care provider designated by any of the Released Persons to provide medical treatment to Participant, should the need arise. I also, for myself and on behalf of my heirs, estate, insurers, successors, and assigns, hereby specifically agree to the releases, assumptions of risks, licensing, indemnity and all other terms of this Release and fully and forever release and discharge the Released Persons (defined above) from all Claims. I acknowledge that I am not obligated to provide any biographical information about Participant, however, choosing to not do so below will not invalidate the scope of this Release as it pertains to the Rights related to Participant and their personality rights under law. I further acknowledge and agree that the right for Participant to participate in the Event is good and valuable consideration in exchange for this Release and neither myself nor Participant will be entitled to any compensation for use of any Materials subject to this Release. I acknowledge that because Participant is a minor, I may rescind this right to use Participant’s likeness in writing to Dash Soccer, LLC, 413 Bastrop Street, Houston, TX 77003, ATTN: Legal Department, and including enough information to afford Released Persons to reasonably identify Participant in order to comply with the request to rescind this Release.
