RENTAL AGREEMENT

THIS AGREEMENT IS MADE AND ENTERED INTO BETWEEN THE UNDERSIGNED GUEST (HEREINAFTER REFERRED TO AS GUEST) AND RELAXONTHEBEACH, INC. (HEREINAFTER REFERRED TO AS AGENT) FOR THE RENTAL OF THE PROPERTY (HEREINAFTER REFERRED TO AS THE PROPERTY).

NOW THEREFORE, IN CONSIDERATION OF THE MUTUAL COVENANTS AND AGREEMENTS SET FORTH BELOW AND OTHER GOOD AND VALUABLE CONSIDERATION, THE RECEIPT AND SUFFICIENCY OF WHICH ARE ACKNOWLEDGED, THE PARTIES COVENANT AND AGREE AS FOLLOWS:

1. Reservation Policies

Beach homes and condos with one, two, three, or four bedrooms:

● Total payment is due if less than sixty (60) days before the arrival date
● If there is more than sixty (60) days before the arrival date, a $250 initial credit card payment is required to reserve a property. This payment is subtracted from your total, so it is not refunded upon your departure
● Final payment is due sixty (60) days before the arrival date

Beach homes with five or more bedrooms:

● Total payment is due if less than ninety (90) days before the arrival date
● If there is more than ninety (90) days before the arrival date, a $250 initial credit card payment is required to reserve a property. This payment is subtracted from your total, so it is not refunded upon your departure
● Final payment is due ninety (90) days before the arrival date

Total payment includes the rent amount, fees, and taxes collected.

Select properties are available (not during the family Summer season) with a refundable security deposit to those under age 25. Total payment (including security deposit) is due in full when a reservation is made. We do not accept on-line reservation requests for any group under age 25.

2. For every reservation, a $250 initial payment is paid with a credit card that is kept on file.

There is no fee if you elect to pay any of the remaining total balance with your checking or savings
account using an EFT (echeck).

There is a 3% fee if you choose to pay any of your total balance (except the $250 initial payment)
with a Visa, Mastercard, Discover, or American Express account. We add this fee to your card which
is on file.

In no event shall Guest assign or sublet the Rental Property in whole, or in part.

We will NOT send you a reminder of your final payment, so please be sure to mark the date on your calendar. If no payment is received 60 days prior to arrival, your balance will be billed directly to your credit card.

3. Damages and Missing Items

Guest will be financially responsible for damage to the property. Guest authorizes RelaxontheBeach, Inc. to charge Guest’s credit card in the event of the following: damage or theft; flea infestation caused by a pet; unauthorized pets; extensive cleaning required at check-out; evidence of smoking (all properties are non-smoking); exceeding occupancy or parking limits, and any other mentioned charges/policies in the RelaxontheBeach Rental Agreement. Guest will be notified of any damage/costs in writing. Excessive damage may result in Guest being charged for the relocation or compensation to incoming guest if check-in is delayed as a result of said damage. Any material damage to the Rental Property will be charged immediately to the Guest’s credit card. Guest, in signing below, assumes full responsibility for any items damaged due to misuse or negligence and for any items found to be missing. Guest is responsible for notifying RelaxontheBeach immediately upon check-in if the Rental Property is found in less than good condition or any damage (other than normal wear and tear) is noted. If damages occur during your stay, please notify us immediately.

4. Refunds

The Rental Agreement is a legally binding agreement between Guest, RelaxontheBeach, Inc. and the Property Owner. Your reservation and signed Rental Agreement bind you to a specific property for a specific period of time. There should be no expectation of refunds or relocation because you are disappointed with the property you have rented or in the event that something associated with the property is not working to your satisfaction. All properties are privately owned and furnished per the owners’ requirements, so unlike a hotel, we cannot relocate you without specific authorization from the Property Owner. In the event that a problem arises during your stay, we will make every attempt to solve it in a timely manner. There will be no refunds for mechanical failure of appliances, a/c units, etc. Travel Insurance is available for purchase up to 60 days prior to your arrival. See Travel Insurance paragraph later in this agreement.

5. Cancellation Policies and Fees

Please email us if you need to cancel your reservation. Written (email) notice is required for all cancellations.

* 60 day advance written notice is required for reservations with less than 5 bedrooms.
* 90 day advance written notice is required for reservations with 5 or more bedrooms.
 
If it is necessary to cancel your reservation with more than the required advance notice, we will refund the total paid (initial $250 payment plus any rent, fees, and taxes paid) minus a $100 cancellation fee. Travel insurance payments are not refundable. 

Cancellations occurring with less than the required advance notice will result in forfeiture of the initial payment plus any rent, taxes, and fees paid.
 
Select properties are available (not during the Summer family season) with a refundable security deposit to those under the age of 25. We do not accept cancellations for reservations to those under the age of 25.
 
To protect your vacation investment, RelaxontheBeach strongly recommends you purchase travel insurance. If you decline the optional travel insurance, you acknowledge that changes or cancellations may result in loss of up to the total paid to date.

Please note: If you have purchased Trip Cancellation insurance at the time of making your reservation please refer to your policy for instructions on recovering your loss due to cancellation. The travel insurance fee cannot be refunded. In no event shall Guest assign or sublet the Rental Property in whole, or in part.

6. Travel Insurance

RelaxontheBeach has contracted with Travel Guard 1-877-249-5376 in order to offer trip cancellation insurance. This travel insurance is intended to protect your vacation investment against hurricane evacuations, injury, sickness, recent job loss, or death and other unforeseen covered circumstances, which could cause cancellation of confirmed reservation. The optional trip cancellation insurance cost is 7% of the total Reservation charges and can be purchased either at the time of making the reservation or prior to paying your Final Balance. Payment for the plan will not be accepted after RelaxontheBeach has received your total balance due.

We recommend that all Guests purchase this coverage for added financial protection in cancellation situations where we are unable to refund payments. You will have 10 days from the date you receive the trip cancellation policy to review the policy and cancel, in writing, if you do not elect to purchase this coverage. Refunds and coverage issues will be based and determined solely by Travel Guard and the existing policy will be issued to Guest if coverage of this insurance has been elected upon making reservation.

7. Hurricane/Weather Evacuation

In the event of an ordered evacuation due to hurricanes or other storms, you are required by state law to evacuate property. If you have declined trip cancellation insurance, you shall not be entitled to a refund. Refunds and coverage issues will be based and determined solely by Travel Guard and the existing policy will be issued to Guest if coverage of this insurance has been elected upon making reservation. Refunds for the period of mandatory evacuation will be made solely by Travel Guard, provided Guest has purchased optional trip cancellation insurance. Refer to trip cancellation policy or contact Travel Guard directly for specific information and/or refund procedures. If you choose to leave due to “Storm Warnings” or “Voluntary Evacuation” no refunds will be given. RelaxontheBeach will not issue refunds in part or in full for inclement weather. Our recommendation for travels during hurricane season is for you to research and purchase trip cancellation insurance.

8. Indemnification

The Guest agrees to indemnify and hold harmless Agent and Owner for any damages to or loss from the rental house, grounds, furnishings, appliances, household items and any other of the Owner’s property resulting during the Guest’s rental term, normal wear and tear excluded. The Guest further agrees to indemnify and hold the owner and the rental agent (RelaxontheBeach, Inc.) harmless from any claim or liability for any loss or damage whatsoever arising from, related to or in connection with the rental of this rental property, including but not limited to any claim for personal injury or damage or loss of property which is made, incurred or sustained by the Guest or other occupants or invitees of Guest. Neither the owner nor the agent is responsible for any of the Guest’s or other occupant(s) valuables, cash or other property during the rental term or thereafter left at the rental house.

9. Important

Rental Properties are for family vacations only: RelaxontheBeach gladly rents to families or responsible adults over the age of 25. RelaxontheBeach has a “No-Group” Policy, which includes but is not limited to the following: school, spring break, prom, graduation, etc. RelaxontheBeach MAY approve at the time of reservation and at our discretion with a significant additional damage deposit, rental to groups, but you must disclose at the time of reservation that you are a non-family group. Absolutely no house parties, overcrowding events, or kegs! Properties are stocked according to their maximum occupancy. Requests for extra items such as towels, sheets, blankets etc. will incur an additional fee to include delivery of items.

Guests shall respect and not interfere with the rights, comfort or convenience of adjacent homeowners or occupants. If Guests violate any of the terms of this agreement, a RelaxontheBeach agent may, at his or her sole discretion, evict Guests and occupants of the property with no refund, which will also include, if applicable, Guest's security deposit. Additionally, if evicted, Guest’s credit card will be charged a $250 eviction fee. RelaxontheBeach reserves the right to refuse service to anyone. All rental properties are leased without regard to race, color, religion, sex, national origin, handicap or sexual orientation.

10. Keys

Each property will be given 2 keys. A replacement charge of $30 per key will be applied to lost keys. We recommend leaving at least 1 key in the lockbox at all times to prevent lock outs. Charges for lockouts are as follows: $35 during business hours; $50 after hours.

11. Items Left Behind

Should you leave anything behind, we will be happy to mail it to you at your expense with a Relax on the Beach service charge of $25, which will be charged to your credit card on file. In addition, you will need to supply your shipping address and credit card information to UPS or equivalent to pay for shipping charges.

12. Important To Note

No illegal substances are permitted on the property at any time. Underage drinking is strictly prohibited and may result in eviction without refund. Quiet time – the noise curfew is 10PM in all residential areas and all guests are expected to comply.

13. Non-Smoking Property

All RelaxontheBeach properties are non-smoking properties. Smoking of any kind is strictly prohibited. This includes, but is not limited to cigarettes, cigars, pipes, vaping devices, e-cigarettes and drugs. Smoking in any property is a serious breach of contract and will result in additional charges and possible eviction. There will be a minimum $250 charge to Guest if evidence of smoking is discovered. The process of eliminating smoke odor (ozonation, cleaning of furniture, drapes, bedding etc..) can become very costly. If you smoke, you will be charged.

14. Check-In

Check-in time begins at 4:00 PM CST. RelaxontheBeach will make every attempt to have your property ready for check in at 4:00 PM CST. We can't guarantee this time, however, as there are situations which occur beyond our control. Agent may offer a priority arrival time at a nominal fee for early check-in for off-season reservations. There will be no early check-ins during summer months. Check-in instructions and details will be sent to you upon receipt of rental payment.

15. Check-Out

Check-out by 10:00 AM CST. To avoid additional charges, please abide by our check out time and procedures! Cleaners have limited time to prepare property for the next guests. If Guest stays past the check-out time and interferes with cleaners coming to prepare for the next guests, Guest will be billed for an additional day. Check-out instructions and details will be sent to Guest upon receipt of rental payment.

16. Inability to Deliver Property

In the event that the owner of the Property (hereinafter Owner) is unable to deliver the Property to Guest prior to occupancy because of fire, eminent domain, act of nature, double booking, delay in construction or any other reason whatsoever, Guest hereby agrees that Agent's and Owner's sole liability as a result of these conditions is a full refund of all consideration previously tendered by Guest. If at the time Guest is to begin occupancy of the Property, Agent cannot provide the Property in a fit and habitable condition or substitute a reasonable comparable property in such condition, Agent shall refund to Guest all payments made by Guest. Agent reserves the right to substitute comparable accommodations if circumstances require. Pursuant to the terms of this Agreement, Guest expressly acknowledges that in no event shall Agent or Owner be held liable for any consequential or secondary damages, including but not limits to, any expenses incurred as a result of moving for any damage, destruction or loss.

17. Parking

Parking varies by property, and payment for parking passes, when applicable, has been included in your rental fee. Unless otherwise noted, condominiums limit Guest to a maximum of two (2) parking passes. This 2 vehicle limit applies to condominiums ONLY.

18. Telephone Calls

If a telephone is provided at the Property, Guest may make unlimited calls within the local exchanges. Calls outside of the local area or information request calls are additional and Guest is expected to use a calling card. Agent will accept no toll telephone charges for any reason whatsoever. If charges are incurred during Guest’s stay, Guest’s credit card will be billed for these charges.

19. Use of Property

Guest shall keep the Property as clean and as safe as the conditions of the Property permit, causing no unsafe or unsanitary conditions in the common areas or remainder of the Property that Guest or its invitees uses. Guest agrees not to use the Property or permit the Property to be used for any illegal or unlawful activity or purpose. Guest shall not assign this Agreement or sublet the Property in whole or part.

20. Furnishings

RelaxontheBeach is a vacation management company. All properties are equipped to owner specifications. RelaxontheBeach does not provide additional items without a $50 service call charge/rental fees to Guest. Transfer of furnishings of any kind from one property to another or the rearranging of furniture in or on the Property is strictly prohibited and will result in additional charges. Loss to these items, as well as damage to the Property or its furnishings in excess of normal wear and tear will be charged to Guest. Guest is expected to leave property and contents in their original conditions and positions upon departure.

21. Appliances/Equipment

RelaxontheBeach makes every effort to ensure all appliances and equipment are in working order. If you experience a problem during business hours, please call the guest service number and we will make every effort to resolve the issue in a timely manner. If you experience a non-emergency problem after hours, please call the following morning. In the case of an emergency (loss of heat or air, fire or flooding) please contact our 24 hour emergency number. There are no rebates or refunds issued to guests for any reason as every good faith effort is made to ensure the Property is maintained to highest standards. Refer to property listing for information on items included with the Property.

22. TV, Cable or Internet

These amenities are provided by the homeowner and differ from property to property depending on each individual homeowners’ preference. If you experience a problem with any of these items, please refer to the TV, Cable or Internet section of the welcome book. If you are unable to solve the problem with the information provided, please contact the appropriate provider listed in the welcome book located at the property. If they are unable to assist you and a technician is required please call our guest service number during business hours to set up a service call. RelaxontheBeach is a vacation rental and management company. We do not staff trained technicians in this field.

23. Linens/Towels

Blankets and pillows vary by property as each property is individually owned and furnished at the Homeowner’s discretion. Additional blankets, pillows, etc. are available upon request for a fee. Damaged or missing items will be charged to the guest. No contents of the Property, including linens, blankets or towels, shall be taken to the pool or beach. RelaxontheBeach stocks and inventories all linens prior to guest arrival and upon departure. Should linen be missing or damaged, Guest’s credit card will be billed a minimum of $50.

24. Locked Areas

Areas for which Guest is not provided a key, such as Owners' personal storage areas, are exempt from this Agreement and are off limits to Guest. Forced entry into these locked areas is cause for immediate eviction and Guest will be charged for damage and/or missing items as well as a $250 eviction fee.

25. Grilling

Fire department regulations prohibit the use of grills on all decks, porches, and balconies. Some properties have areas for grilling. Refer to property listing.

26. Garbage Removal

It is Guest's responsibility to take the garbage out on designated days. Garbage is picked up twice a week. In some locations depending on the time of year, it is picked up three times. Please refer to your welcome book for designated times. Please place all garbage in outside collection bins upon departure. Excessive accumulation of trash that does not fit in bins on check-out day will result in an additional charge for garbage disposal.

27. Entry to Property

Guest agrees that Agent, Owner or their respective representatives may enter the Property during reasonable hours to inspect the Property, and to make such repairs, alterations, or improvements thereto, as Agent or Owner may deem appropriate, or to show the Property to prospective purchasers or guests.

28. Surrender of Property

Prior to vacating the Property, Guest shall perform the following: All dishes cleaned, dry and placed in the cabinets. All trash removed from the Property and placed in outside receptacle. All doors and windows closed and locked. All keys returned to the lockbox by check-out time. Any damage should be reported to rentals@relaxonthebeach.com. If Property is not left in good condition, excessive cleaning charges will apply and Guest's credit card will be charged.

29. Rules and Regulations

Guest shall abide by all rules, restrictions and regulations that may now, or hereafter, apply, including, but not limited to the provisions of any condominium or homeowners declaration, bylaws, and/or rules and regulations, if applicable.

30. Release of Liability

Neither Agent nor Owner will be responsible for accidents or injury to Guest, any members of its party or any invitees to the Property or for the loss of money or valuables. Guest is expressly responsible for the safety of itself and any members of its party and any invitees to the Property, and in so using or permitting to be used the Property and the recreational or other facilities associated with or a part of the Property, specifically waive any and all liability claim, expressed or implied, against Agent, Owner, and any condominium or homeowners association, if applicable.

31. Waiver of Jury Trial

GUEST HEREBY KNOWINGLY, VOLUNTARILY, AND INTENTIONALLY WAIVES ANY RIGHT GUEST MAY HAVE TO A TRIAL BY JURY WITH RESPECT TO ANY LITIGATION ARISING OUT OF, UNDER, OR IN CONNECTION WITH THIS AGREEMENT. GUEST ACKNOWLEDGES THAT AGENT HAS BEEN INDUCED TO ENTER INTO THIS AGREEMENT BY THE PROVISIONS OF THIS PARAGRAPH.

32. In the event of breach of this Agreement by Lessee, he/she will be liable for all damages occasioned by said breach PLUS reasonable attorney's fees and costs of court.

33. Pet Policy

Well-mannered, house trained dogs are welcome at many of our properties. We do not accept other types of pets, and there is a size limit for some of our properties. A $100 nonrefundable pet fee is required per dog, limit 2. If you are bringing your dog, please review our Pet Policies:

• Dogs are not allowed on the furniture or beds -- if any evidence of such is found after check-out, guest will be responsible for all laundering and cleaning charges.
• Please clean up dog “poo” in the yards or on the beach or other public areas
• Crates: if you normally crate your dog at home, we ask that you crate him/her here as well.
• Please do not leave the dog(s) outside in the yard unattended.
• Flea and tick protection- fleas are here in full force! Please be sure your animals are current on their flea protection medicine.
• Please abide by beach rules about where dogs are allowed. No dogs at all on West Beach in Gulf Shores or Orange Beach. Dogs ARE allowed on the beach in Morgantown and St. George Island.
• Dogs are not allowed in pools or pool enclosures.
• Excessive barking, that results in complaints from neighbors, could result in immediate eviction. Please control your dog's behavior at all times.
• Bringing dogs into NON-pet friendly properties is prohibited. It is also prohibited to bring a non-reported or unauthorized pet into any property. Guests in violation of this rule will be fined $350 per pet to be billed to credit card on file and will risk eviction.
