This survey is prepared by Transforming Communities for Inclusion – a global OPD/movement of persons with psychosocial disabilities. The survey will highlight the lived experiences of persons with psychosocial disabilities around legal capacity and inclusion in decision-making processes.
Objectives of the survey:
1. To document lived experiences of persons with psychosocial disabilities in exercising their legal capacity across all areas of life.
This includes decision-making related to personal autonomy, finances, health, family, education, work, political participation, and community inclusion. The aim is to capture how laws, policies, and social attitudes enable or restrict the right to make decisions as guaranteed under Article 12 of the CRPD.
2. To identify structural, legal, and social barriers that undermine equal recognition before the law.
The survey seeks to uncover discriminatory practices—such as guardianship, involuntary treatment, and denial of right to identity—that limit persons with psychosocial disabilities from fully enjoying their rights, and to highlight gaps in supported decision-making systems.
3. To generate evidence that informs advocacy for reforms and inclusive support systems mechanisms.
Findings will guide TCI and its members in developing policy recommendations, strengthening OPDs’ advocacy, and promoting models of supported decision-making that respect will and preferences, in line with CRPD standards.
