AB 1826 Mandatory Organics Recycling Exemption Request Form |
Effective January 1, 2019, California State Law AB 1826: Mandatory Organics Commercial Recycling requires businesses and multifamily dwellings that generate more than 4 yards of solid waste, recycling, and organics per week, to enroll in an organic waste recycling program.
Organic waste includes food waste and green waste. Food waste is defined as vegetables, fruits, meats, poultry, seafood, pastas, breads, eggshells, coffee and tea grounds. Green waste is defined as landscaping and grass clippings, leaves, branches, flower trimmings, hedge trimmings, weeds.
California Public Resources Code Section 42649.82(e)(3) allows the jurisdictions to consider exempting businesses and multifamily dwellings from the requirements of California Public Resources Code Section 42649.81, on a case-by-case basis, when the jurisdiction determines that the business meets an exemption criteria.
Jurisdictions and Cal Recycle, the State Regulatory Agency, will review the exemption request, and retain final authorization on granting or rejecting the exemption.
