Introduction

The following survey is intended to assess the need for an electronic process for obtaining a warrant for an emergency detention, sometimes known as an Emergency Detention Order (EDO). 
 
Background: Under the emergency detention statute (Chapter 573, Health and Safety Code), a person may be detained by a peace officer if the person has a mental illness and because of that mental illness there is a substantial risk of serious harm to the person or to others (see section 573.001). Alternatively, any person may apply for a warrant for an emergency detention under those same circumstances (see section 573.012).
 
The following questions pertain to the emergency detention processes described above. Please note that these questions do not pertain to Orders of Protective Custody (OPCs) issued under chapter 574, Health and Safety Code.
