SURVEY: Recreational Cannabis Sale, Smoking and Vaping

Recreational cannabis sale and use could become legal in Canada in 2018, and each province is responsible for setting some guidelines and legislation. Visit the Alberta Cannabis Framework website for details.

Some decisions on how to regulate the sale, smoking and vaping of cannabis are left up to local governments, including:
-          Where cannabis retail stores can be located
-          Business licensing
-          Policies and bylaws on smoking and vaping

Your comments will be used to identify community opinions and concerns, and will be considered by the Municipality of Jasper and Parks Canada as decisions on local bylaws and regulations are developed. We will keep you informed and provide feedback on how the public input was considered.

Jasper is a national park community and part of a UNESCO World Heritage Site. As such, it is not only home to residents – it is also a destination for visitors from across Canada and around the world. This unique environment will be taken into account as the Municipality of Jasper and Parks Canada regulate cannabis sale, smoking and vaping in the community and the national park.

CANNABIS RETAIL STORES
The proposed federal and provincial regulations on cannabis allow the sale of cannabis, but prohibit its consumption in retail stores. The co-location of cannabis products with pharmaceuticals, tobacco or alcohol is also prohibited.

If cannabis retail is approved in Jasper, it is proposed that it will be allowed in the downtown commercial district only. Local governments can also limit the number of retail stores in a community.

Currently there are no restrictions on the number of stores of any permitted business in Jasper.

STORE LOCATIONS
In Jasper, street level stores are where retail for visitors and residents mainly occurs. Second storey and below grade (basement) commercial spaces are limited to commercial operations deemed to be Resident Oriented Services. However, amendments for this unanticipated use can be considered.

HOURS OF OPERATION
In Alberta, provincial regulations set the maximum hours of operation for cannabis stores to be aligned with limits for liquor stores, which are currently 10 a.m. to 2 a.m., seven days a week. Local governments have the option to further restrict these hours. Stores could also choose to be open for less than the maximum hours of operation.

CANNABIS SMOKING AND VAPING IN JASPER
Across the country, cannabis smoking and vaping either follows the liquor rules or the tobacco rules. In Alberta, the province chose to follow the tobacco model, which means Albertans will be able to smoke or vape cannabis in their homes and in public places where smoking tobacco is currently allowed (under the Alberta Tobacco and Smoking Act and Regulation and under the municipal Smoking Control Bylaw).

Provincial legislation also prohibits cannabis smoking and vaping:
-           on hospital, school or child care facility property;
-           in any motor vehicle, except when used as temporary accommodation (such as RVs); and
-           within a prescribed distance from playgrounds, sports fields, and skate or bike parks, among other areas.

The Municipality of Jasper can choose to restrict cannabis smoking or vaping beyond the provincial laws through municipal bylaws.  

The options range from allowing cannabis smoking and vaping anywhere smoking is allowed currently, to a full ban on cannabis smoking and vaping in any public space, excluding medicinal cannabis use.

ENFORCEMENT
Managing cannabis smoking and vaping in Jasper will require enforcement. At this time, no support to municipalities is being offered through cannabis taxation. Enforcement costs would have to be covered by local property taxes, business licensing fees or reallocation of enforcement time from other municipal priorities.
