Feedback Request: Draft rules adding biotech to the Comprehensive Outbound Investment National Security (COINS) Act

On October 22, the U.S. Department of the Treasury released proposed rules implementing the Comprehensive Outbound Investment National Security (COINS) Act. For the first time, biotechnology is included among the sectors subject to outbound investment restrictions and notification requirements. Treasury has also published a fact sheet and FAQs that give a useful overview of what the proposal would cover.

We need your input. MassBio will submit formal comments to Treasury before the December 7 deadline, and our comments will be stronger with real examples from our members. If your company has concerns about the proposal, or questions about how a current or planned partnership, investment, financing, or other activity could be affected, please share them below by Friday, November 13.

We will treat what you share confidentially. We will not identify your company or share specific deal details. Instead, we will use your input to raise the underlying issues with Treasury, both in our written comments and in our ongoing conversations with officials. If you have any questions, please reach out to Director of Federal Policy & Strategic Initiatives Nathan Dinh.
