We are developing a new policy for Argyll Community Housing Association's (ACHA) use of our own CCTV system. We are seeking your views on the new draft policy.

* 1. ACHA has a mobile CCTV system which we can use if required as a means of detection and as a deterrent to anti-social behaviour and crime. We will only use our CCTV system in exceptional circumstances, where there are reasonable grounds for doing so and where there is no less intrusive way to tackle the issue.

* 2. Any installation of ACHA’s own CCTV will be subject to a Data Protection Impact Assessment (DPIA), which will follow the Information Commissioners Guidance. ACHA will maintain a record of DPIAs as a record of decision making, installation and review.

* 3. Any installation of ACHA's own CCTV system will be subject to a consultation survey being carried out with all residents and stakeholders whose privacy is likely to be affected and the views of the consultees taken into account.

* 4. Our CCTV camera will not be used to record sound as this is unnecessarily intrusive.

* 5. Access to all CCTV equipment and images captured by ACHA’s CCTV system will be strictly controlled to authorised personnel only. The data gathered will be stored in a way that maintains its integrity and security. This may include encrypting the data and storing video footage using a cloud storage system.

* 6. Data from our CCTV system will be kept for a maximum of 31 days before being erased unless required for a specific enquiry or as evidence.

· Prosecuting agencies

· Legal representatives

· Local Authority

No images from our CCTV cameras will be disclosed to any third parties without express permission being given by our Data Protection Officer.

* 8. All requests by individuals for footage recorded by our CCTV system will be treated as a Subject Access Request (SAR). In doing so ACHA acknowledges the requirement to balance the rights of data subjects against those of other individuals who appear in the requested images. We reserve the right to obscure images of third parties when disclosing our data as part of a SAR where we consider it necessary to do so.
