Generally the debate now is about how level 25'ers should lose XP. As they dip below 100% experience, they will suffer stat loss until they recover the XP. (Mind you there will be a cap similar to under level 25, so you will only be able to lose X experience to a point.) XP can be gained by quests, oads, etc, so regardless I don't see any option being a problem.

* 2. Should you be able to buffer experience at level 25? (AKA go above the max level cap). This means if you die, you won't dip below the minimum XP (and won't get any negative effects just from one death.)
