Survey Re: Background Check Delays

SHRM California Government Affairs Survey

Since 2021, as a result of a decision in a California appellate case entitled All of Us or None - Riverside Chapter vs. Hamrick, courts no longer permit records to be filtered by date of birth or drivers' license number. Prior to 2021, this process was commonly used by organizations performing background criminal history checks. While SHRM California, has not taken a position on this issue, we are conducting a survey to determine if this change in law impacts our members. Please complete the survey by letting us know the following:
1.Has your company/organization experienced delays in performing background checks because of this change?
2.If your response to question number 1 is "yes", please describe these delays, including approximately how much longer these background checks take to complete.
3.Has your company/organization experienced incomplete or unreliable background checks because of this change?
4.If your answer to question 3 is "yes", please describe how the quality of these background checks is impacted by the change in law.
5.What is your profession?
6.What type of industry do you work in?
7.If you have any other feedback on the impact of this change or suggestions to improve the background check process, please describe.
