Survey on Part Year Employment

Before 2006 TAFE NSW had the legal ability to create Permanent Part Year (PPY) positions. At this time there were around 150 or so PPY roles, both full time PPY roles and part time PPY roles. Now TAFE NSW has around 650 Part Year roles, both permanent and temporary.

The PSA(CPSU) wants to see the current temporary part year employees converted to permanent, even where the conversion is to Part Year. The Union believes this can be legally undertaken under a new Agreement.

However the PSA (CPSU) does not believe that the Enterprise Agreement could meet the Better Off Overall Test (BOOT), when compared to the Vocational Education sector Award, that the Fair Work Commission makes when approving the Agreement if Part Year employment is included. The Award for the VET sector does not have PPY roles, only Full Time, Part Time and Casual.

There is the ability for an Agreement to legally allow employees who are working Part Year, to be converted to permanent. As long as the employee is already working, was engaged through a merit selection process and has demonstrated they are Part Year, they can be converted to ongoing part year.

We have seen TAFE NSW turning permanent, full time / full year positions into temporary positions, and temporary part year positions. We oppose this, and are campaigning against it, as this shows the intention TAFE NSW has for more employees in insecure employment, and their intent to INCREASE PART YEAR EMPLOYMENT. This will impact on current permanent staff who will face being declared excess, or receiving a pay cut to work 36 weeks a year instead of 48-52 weeks a year.
