The Criminal Justice Section of the American Bar Association has established a Brady Best Practices group consisting of public defenders, defense attorneys, state prosecutors, state and federal judges, ethics officers, and academics which will study and survey the Brady/disclosure obligations and practices in both state and federal jurisdictions around the country. The group will examine the broad spectrum of criminal cases on both the state and federal side. The ultimate goal of the group will be to propose a model practice for the identification and production, in a timely manner, of exculpatory materials to defendants in state and federal prosecutions. This initial survey is the first stage of the group study and is designed to identify the disparate practices in state and federal jurisdictions around the country. The goal of the survey is to not only document the applicable disclosure rules but to illuminate the actual practices in the various jurisdictions in an effort to better understand the scope of the Brady/disclosure issues that exist.
