NICS 2018 Self Evaluation--Mental Health Agencies and Hospitals |
On April 23, 2018, Governor Kasich signed Executive Order 2018-03K, "National Instant Criminal Background Check System ("NICS") Compliance". The Executive Order directs the Office of Criminal Justice Services (OCJS) to provide the Governor with a report on the current status in Ohio of the reporting and uploading to LEADS or BCI of all relevant information required by NICS, and the barriers prohibiting such reporting.
NICS was established to provide Federal Firearm Licensees (FFLs) with a process to determine whether a person who is attempting to purchase a firearm from the FFL is prohibited from purchasing a firearm under federal or applicable state law.
The following are the firearm prohibiting categories:
· Felony/serious misdemeanor convictions
· Fugitives from justice
· Unlawful drug users/addicts
· Adjudicated mental defective or involuntarily committed to a mental institution or incompetent to handle one's own affairs
· Subjects of domestic violence protection orders
· Under indictment for a crime punishable by imprisonment for a term exceeding one year
· Misdemeanor crimes of domestic violence convictions
· Dishonorable discharges
· Illegal or unlawful aliens
· Renounced U.S. citizenship
A very large portion of the records and information that must flow up into the NICS databases from Ohio must first be supplied and reported by local law enforcement, courts, and mental health providers. Records are submitted from local agencies through LEADS or through the Bureau of Criminal Identification (BCI), which then passes the information to the FBI for inclusion in the databases searched by NICS.

The purpose of this self-assessment is to help mental health providers identify the records for which they are responsible to submit to BCI for inclusion in the databases searched by NICS, and to report on the barriers they face in submitting the records in a timely and complete manner.
