Survey regarding 280 entrance to Asheton Lakes neighborhood

This is an email from developer Ab Conner that he has ask the Board to share with residents on June 29, 2021. We reviewed at the last HOA meeting. Please review if you haven't already. The HOA Board of Directors (BoD) will use the information from this survey to instruct the association attorney in further negotiations. In a prior meeting, the BoD voted to purse option 1.

Dear Asheton Lakes Homeowners

First let me say that I want to develop the 25 acres that are suitable for development in a manner that would be a good fit with the current homes in Asheton Lakes. I have been involved from the very beginning with the development of Asheton Park followed by Asheton lakes and would not want to see anything done with the property that I would not like to see in my own neighborhood. I oversaw the writing of the Declaration of Covenants, Conditions and Restrictions for both neighborhoods and signed the ones for AL’s as Declarant on behalf of North Lake, Inc. on May 22, 2002. I would adopt similar provisions for the proposed houses.

The majority of the new houses will comply with the AL’s design criteria except for the 2,500 SF minimum because I expect most of these homes will be purchased by buyers wanting all on one level living with covered outdoor space. The footprint of the houses would be similar to the existing homes, just without the finished second floor. I would also add James Hardie shakes or board and batten siding as an acceptable exterior material for gables, chimneys and accents, because those products were not available when the restrictions were issued. The provision requiring houses be built to be no less than 24” from the final finish grade around the perimeter of the house is not being enforced. I would enforce a provision requiring the front of the homes to be at least 12” above finished grade. The current plan has 32 lots each 90’ wide which gives adequate room for courtyard or side yard facing garages. I fully expect some of the buyers will come from Asheton Lakes’ residents wanting to downsize and live on one level.

Watercrest Blvd. is a collector street and we have already worked with the City on the layout of the two curb cuts needed. The City and AL-DOT may require a traffic study that could show the need for longer acceleration or deceleration lanes like the one we built recently at the entrance to Asheton Lane.

The easement I am requesting is across the property North Lake deeded to the POA in 2008, so that homeowners not on the other lakes would have access to the lake off of Mt. Vernon Lane. We have always planned to develop the remaining property, but neglected to show the easement. The sewer tie-in can be done by boring so that no visible damage will be done to POA property. Alternatively, the sanitary sewer is accessible via the City’s easements along Watercrest Blvd., but would likely cause damage to the streetscape on that side of the road.

Certain uses in the CDD zones are permitted by right and do not require Planning Commission or City Council votes. If we are not able to work out the easement swaps, I will regretfully sell the property including the entrance signs and no longer have control of what is done with them.
