What is this survey about?

This survey asks questions about general issues on the proposed animal welfare regulations relating to: pain relief; the competent person; the compliance and enforcement regime; implementation of the regulations; and monitoring and reviewing the impact of the regulations.

For more details on these issues, see the full Discussion Document

Question Title

* 1. Your personal details

Question Title

* 2. Name of organisation (if you are submitting on behalf of an organisation)

Question Title

* 3. What is the best way to describe your role? (you can select more than one role)

Question Title

* 4. Pain relief

Do you have any concerns about accessing pain relief? If so, what are these concerns, and how might they be dealt with?

Question Title

* 5. The “Competent Person”

MPI proposes that where a non-veterinarian is allowed to do a procedure on an animal, they must be ‘competent’. The owner or person in charge of the animal has the responsibility to ensure that only competent people perform the procedure.

Is there a better way to ensure that only suitably skilled or experienced non-veterinarians are able to carry out a procedure on an animal? What would this alternative look like?

Question Title

* 6. Do you agree that the owner or person in charge of the animal should have the responsibility to ensure only competent people perform a procedure?

Question Title

* 7. The Compliance and Enforcement Regime

MPI proposes that for regulatory offences, the defences be the same as those in clause 61 of the Animal Welfare (Care and Procedures) Regulations 2018. These are that:
  • the defendant took all reasonable steps to comply with the relevant provision; or
  • the act or omission constituting the offence took place in circumstances of stress or emergency and was necessary for the preservation, protection, or maintenance of human life.
Do you agree with this proposal?

Question Title

* 8. Implementation

Do any of the proposed regulations require a lead-in time (delayed commencement)? If so, what period is reasonable? Are there any other challenges relating to the timing of regulations coming into force?

Question Title

* 9. Monitoring and Review

How should MPI best engage with stakeholders to monitor and review the impact of the proposed regulations?

Question Title

* 10. Grounds to withhold information in this submission

Tell us if you think there are grounds to withhold specific information in your submission (such as commercial sensitivity or personal information). However, any decision MPI makes to withhold information can be reviewed by the Ombudsman, who may require the information be released.
