Part I. QAP Drafts and Schedule

TDHCA is seeking input on the process it will use in developing the 2023 QAP and associated rules and the topics to be discussed. This survey has several parts – in each part the survey provides you information on our plan, process, and topics, and then asks for feedback on what you have read. We estimate the survey will require approximately 15 minutes – please carefully read the content in each section and then provide your responses. Thank you!

Question Title

* 1. TDHCA Staff is proposing to take a different approach to the drafting of the 2023 QAP than that used in the past to improve the ability of the Department to be responsive to suggested feedback and limit the extent to which so many suggestions are deferred to the subsequent year’s QAP. The other associated rules (MFDL, Asset Management, Compliance) would not necessarily go through this same iterative process.

TDHCA’s plan is to do two iterations of a 2023 Draft QAP, each with a comment period as follows:

·  Staff produces a Preliminary Draft QAP based on round tables, research, and other input methods further described below.
·  The Preliminary Draft QAP would be approved by the Executive Director and released for a comment period. Staff is not anticipating that this draft will be presented to the Board and it will not be published in the Texas Register as a draft. However, it will be posted on the Department’s website as a Preliminary Draft for Public Comment with a comment close date. Comment will be accepted in writing; no public hearings would be hosted.
·  Staff reviews all comment.
·  Staff drafts the formal Draft QAP based on the feedback and input received on the Preliminary Draft. Formal reasoned response will not be included from this first round of comments, but responsive changes will have been considered. This draft will be presented to the Board and go through the formal rule making process through the Texas Register and there will be another public comment period, this time the ‘formal’ period.
·   Ensuing steps will be followed as stipulated by statute and consistent with the typical timing you would have expected in the past.

Staff’s hope is that this approach will allow for more impactful changes, and give staff the opportunity to better respond to and integrate critiques and feedback.

Staff’s rough timeline for this approach would be as follows:
January 2022 to May 2022 - Research and Input (more on this in following section)
June 2022 - Staff Drafts Preliminary Draft QAP
Early July 2022 - Preliminary Draft QAP Released
Early August 2022 - Deadline for Comment on Preliminary Draft QAP
(From This Point On Scheduling is Consistent with Statute and Past Policy)
September 1, 2022 - Draft QAP Approved by the Board
October - Public Comment Period
November 10, 2022 - Final QAP Approved by the Board
