TERMS & CONDITIONS

CANCELLATION: 
A cancellation within three (3) weeks of the hire period forfeits any paid fees. All other refundable cancellations attract a $10 admin fee.

BREACH:
If you breach any of the terms in this agreement, we may cancel your hire agreement and forfeit any monies paid, and sue for damages.


INDEMNITY: The Hirer shall indemnify SOHO ARTS and all its agents against all actions and proceedings, claims and demands arising from the Hirer’s use of the premises.

CAPACITY: The maximum number of people (including children) must not exceed 100.

NOISE: The Centre reserves the right to cancel any booking causing excessive noise or showing lack of consideration for the general public or nearby residents. Particular attention should be paid to residents in the vicinity of the hall, especially noise in the car park in the evenings. 

PROPERTY: SOHO ARTS accepts no liability for any loss or damage (including consequential or special damage) to the Hirer, the Hirer’s property or anyone using the Centre during the hire period.

The Hirer must not alter the premises in any way, including painting, applying adhesive materials, or inserting nails or hooks in walls or ceilings; fix any placard, notice or sign for advertising or any other purpose that may damage the building. NO GLITTER PLEASE.

The Hirer must pay for the reasonable cost of any repairs required from the Hirer’s use of the Centre, including furniture, fixtures and equipment.
ADDITIONAL COSTS: The Hirer shall bear the cost of expenses relating to their event including but not limited to:
  • Heating levy – In the colder months a heating levy MAY be charged to the hirer, this negotiated prior.
  • Cleaning – Should the hirer leave the premises in an unclean, untidy state, SOHO ARTS will charge the hirer a minimum $50 cleaning fee and $35 per hour thereafter.
  • Equipment & technical support.
EQUIPMENT: The Hirer must ensure that any electrical appliances brought on to the premises have been tagged and tested and comply with Australian Standards.

SECURITY: The Hirer is responsible for the safe return of the hall keys to the key safe. If lost or damaged the Hirer is responsible for any costs to replace them and in a worst case scenario pay for locks to be replaced. If the Hirer should set off the security alarm or the fire alarm when there is no cause, either by accident or misunderstanding and the relevant services issue a false alarm fee; any charges associated will be the responsibility of the Hirer.

CONDUCT: The Hirer is responsible for the conduct of their guests. It is the Hirer’s responsibility to ensure all their guests leave the premises in a timely fashion after the event, and with consideration to residential neighbours.

INSURANCE & RISK: The Hirer should maintain Public Liability insurance of $10,000,000. The Hirer MAY be requested to provide a risk assessment depending on the nature of the usage of the hall.

FIRE & EVACUATION: The Hirer must familiarise themselves with the Centre’s evacuation plan and nominate a chief fire warden in the event of evacuation.

SMOKING: SOHO ARTS is a non-smoking facility and smoking is prohibited in all areas of the premises. The Hirer is responsible for their guests and visitors to uphold this rule.

LICENCES: It is the Hirer’s responsibility to comply with any licence issues including APRA, copyright and liquor licences where applicable.

SERVING OF ALCOHOL: A request to serve alcohol must be made in writing to the Centre Manager before the Hirer finalises the hire agreement and before applying for a liquor licence. All persons serving alcohol MUST have an RSA certificate, a copy of which must be submitted prior to the event. This is State Law; see the Tasmanian Government Liquor and Gaming Commission for more information.

CAR PARKING: Hirers and their patrons must abide by the rules of the parking available in the Centre and are subject to any penalties.

GENERAL:
  • No animals except assistance dogs.
  • The serving area in the hall is NOT a commercial kitchen and cannot be used to prepare food but can be used to serve food.
  • The Hirer must not leave property in the hall after their hire period, unless a prior arrangement has been made.
  • SOHO ARTS or their representative can enter the building at any time to check everything is in order.
REDUCING WASTE AND LANDFILL:
All food service using disposable containers and utensils must be certified compostable.

Please no plastic "micro-bead" and glitter products such as balloons, flags and promotional paraphernalia and plastic single use water bottles.Nothing in this agreement shall be interpreted as constituting a partnership between the parties or shall render them liable to, or for debts and/or liabilities of the other.


SOHO ARTS has discretionary power to change the terms of this agreement .

The hirer is only permitted to access the hall for agreed hire dates and times. Accessing the hall at any other time without specific permission constitutes a breach in the agreement and may forfeit any future use of the hall.

All bookings made after 18 March 2020 are the responsibility of the hirer. The regular cancellation policy will apply to any bookings made after this date.
