Maribyrnong City Council Survey...

The ASU is seeking member feedback regarding the settlement offer that Council has tabled regarding the Enterprise Agreement negotiations.

There has been a round of update meetings this week however, we are aware that not all members were able to attend, as such we havre generated this survey to ensure your voice is heard!

Please see below dot points which detail the offer;

Council's Offer:

Reductions

Transfer of Business - New clause that REMOVES the right to redundancy entitlements when services are contracted to a new business as has occurred for home care workers. If this clause goes through it will mean that you won't be entitled to a redundancy in this situation;

Redundancy entitlement - Reducing the redeployment period from 8 weeks to 4 weeks will result in a potential loss of possible redeployment opportunities;

Casual Employment- Right to request to convert extended from 6 months to 12 months. This would an additional 6 months prior to a casual employee being able to convert to a permanent employee.

Improvements

Service Recognition Day - Additional day after 10 years continuous service;

Superannuation on unpaid portion of maternity leave - $300 once off payment (pro rata for part time staff);

Bereavement leave - Increase to 4 days.

Wording changes

Personal leave clause to reworded - No loss or improvement to condition;

On - Call Availability & Standby - Rewording with no loss or improvement to condition.

Wages & Terms of Agreement

3 year Agreement;

2% or $22 whichever is a greater increase pro rata for part time staff payable from 1 July 2019 / 2020 / 2021.

Other

Local Work Area Appendices - Subject to further discussion at this point only significant changes are proposed within the Aquatic Centre Appendix.

Consultative Committee- expanding out the function of the committee

Redundancy Improvements- Remove cap of 48 weeks and increase by 1 week each year per year of service (Currently Clause 27.1.6- 3w/p/y/s and 48-week cap)

End of band improvements- Additional day Annual leave and subsequent years once you reach the top of your banding

Higher Duties - To be paid at the same banding as the replaced employee or $100 per week whichever is greater. Clarification that this will be paid from 1 day

Service recognition day- Increase to 2 days per following completion of 5 years continuous service (Clause 52-currently 1)

Sick Leave: Adopting the current policy within the EA regarding when a medical certificate is required:
Broadening out the definition of ‘medical practitioner’ to ‘medical professional’ and to allow for certificate of attendance to be accepted i.e. dentist, specialist etc

Advertising of positions- to occur internally in the first instances then externally

No contracting out and no forced redundancies for the life of the agreement

Labour hire not used to replace permanent roles and no less favourable conditions-This to extend to also include the same work procedures needing to be met for labour hire staff as direct employees

Superannuation: Increase employer superannuation contributions by.5%, Soft compulsion (extra contribution scheme) – Vision

Superannuation paid on the unpaid portion of maternity leave

Use of leisure centre for free for staff

Training- staff to be paid for total duration of training course not average hours (including union training)

ASU access to staff inductions

Cultural and ceremonial leave days to be increased to 3 days paid per year (Clause 55 - 1-day paid leave)

Heated off Clause- when temperature reaches 36 degrees staff will cease work

Disciplinary Procedure to be incorporated within the EA- Including natural justice principles and time frames

Transmission of business: Must be in accordance with the ACT, Extended period of maintaining wages and conditions and Choice of redundancy or transfer

Library staff: Access to 9-day fortnight and Improvements/options for meal breaks

Enforcement officers: To be paid for their lunch break, Access to a 9-day fortnight, Hot places allowance to be increased in dollar amount and removal of the 1 hour’s time frame and reduction to the temperature (Currently Clause 23.1.13 Part B-1HR/46CENTS/45DEGREES)

Home care: Paid time for car service, Excess paid by Maribyrnong City Council for work related accidents and Shock resistant covers provided/ phone repairs covered

4 % per annum salary increase over a 3-year term and linked to a banding

Dispute resolution clause to include any work-related matter

Right to access flexible work arrangements on return from maternity leave (in place of right to request)

Paid delegates meeting

Bereavement leave increases from 3 to 5 days- broadening out the term family and inclusion of pets

Right to casual conversion to permanent after 6 months- This claim to also include the right for agency staff to be converted to permanent council employees following this duration within the same role

Increase to Maternity and Paternity leave by 2 weeks’ primary and 1 week secondary

Workload clause

Inclusion of study leave provisions- increase to dollar amount to $5000 per year, which can be contributed to employees HECs payment not just upfront course fees. Including allocated time for exam study within clause

Employees currently classified and paid under the Local Work Area Appendices to have an equivalent banding under Appendix 9- which will allow for yearly increments to be payable
