Introduction

Since June 2011, DHS has made a number of announcements and issued several memoranda regarding the exercise of prosecutorial discretion within its component agencies. Most recently, on November 17, 2011, ICE announced a pilot program in Baltimore and Denver, and a nationwide review process for OPLA attorneys as part of its plan for implementing prosecutorial discretion. AILA and the American Immigration Council’s Legal Action Center are reaching out to attorneys nationwide to gather information about how the new memoranda and reviews are being implemented in the field.

We need your help! If you have a case where the issue of prosecutorial discretion has been raised AFTER November 17, 2011, please take a moment to complete this survey about your experience. Please fill out a separate survey for each individual case. If you do not have a specific case but have spoken to ICE officials in your area about the pilot program or reviews announced on November 17, 2011, please complete the survey as well. Please note that we may publish a compilation of the survey results at a later time, but will remove all identifying information before doing so.

The entire survey consists of 15-23 questions and will take approximately 15 minutes to complete.
