In exchange and consideration for assistance in connecting [[XYZ ORGANIZATION]] with volunteers, [[XYZ Organization]], including its officers, trustees, agents, employees and volunteers (collectively “Releasor”), hereby irrevocably and unconditionally releases and forever discharges Vermont State Colleges and Vermont Technical College (collectively “Releasees”), including their past, present and future administrators, agents, employees, officers, trustees and representatives (in their official and individual capacities), and all persons acting or allegedly acting by, through, under or in concert with the Releasees, from any and all liability whatsoever for any and all damages, losses or injuries (including death) sustained by any Releasor, or any damages to or losses of Releasor’s property, including but not limited to any claims, demands, actions, causes of action, judgments, damages, expenses and costs, including attorney fees, which arise out of, result from, occur during, or are connected in any manner with Releasees’ students’ participation with or service to [[XYZ Organization]], whether such damages, injuries or losses are caused by the negligence of the Releasees or otherwise; except such injuries, damages or losses which are the direct result of gross negligence and/or intentional misconduct by the Releasees. I also acknowledge that Releasees make no warrantee or otherwise vouch for the quality or sufficiency of the work any such student volunteers may perform and that these student volunteers are not agents of Releasees. Further, in exchange for Releasees’ assistance in connecting with volunteers to [[XYZ Organization]], Releasors hereby accept any and all liability arising out of the performance of such services.
I agree that this Waiver and Release Agreement is to be construed under the laws of the State of Vermont, and that if any portion thereof is held invalid, the balance hereof shall, notwithstanding, continue in full legal force and effect. I agree that this Agreement is to be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law. In signing this document, I hereby acknowledge that I have read this entire document, that I understand its terms, that I have proper and lawful authority to sign on behalf of Releasors, and that I have signed it knowingly and voluntarily
