In June 2021, the State of Connecticut adopted Public Act 21-1, which legalizes the use, production and sales of adult-use (recreational) marijuana in the State of Connecticut. The Town of Mansfield is seeking community input on a proposed framework for regulating establishments that produce, sell, manufacture, package, deliver, or analyze cannabis/marijuana.  Before draft regulations are prepared, the Town Council and Planning and Zoning Commission (PZC) would like feedback from the community.

The Commission is considering permitting sales of both adult-use (recreational) cannabis and medical marijuana, product manufacturing and packaging (including food and beverages), delivery services and laboratories in certain locations as described in this survey.  Per Statute, there can only be one establishment that sells only adult-use cannabis/marijuana until June 2024, at which point the State may increase the number of adult use retail establishments.  Establishments that sell medical marijuana or a combination of medical marijuana and adult use cannabis do not appear to be limited in number by the State. The Town will receive 3% of gross receipts from establishments that sell cannabis/marijuana, these proceeds can be used to fund specific activities as defined in the Statute.

At this time, the Commission is proposing to prohibit cultivation and production of cannabis/marijuana Town-Wide until more research is conducted to understand the potential impacts of a cultivation facility.  The Commission is also proposing to include cannabis/marijuana establishments in the list of uses prohibited as home occupations.

All cannabis establishments would require special permit approval from the Planning and Zoning Commission, which includes a requirement for a public hearing and mailed notice to all property owners within 500 feet. Note: While the Town can regulate certain establishments, it cannot prohibit delivery or transportation of cannabis/marijuana to a consumer in Mansfield.
