A letter of agreement between the "Staff Member" and Maccabi Canada regarding international Games including: Maccabiah, European Maccabi Games, Pan American Games and the Maccabi Youth Games, (hereinafter collectively referred to as the "Maccabi Games Program") (the Agreement).

The goal of Maccabi Canada at the Maccabi Games Program is to maintain the highest standard of sportsmanship, respect, and professionalism to all players, coaches, officials, spectators, and staff at every game, practice and Maccabi Canada event.

Maccabi Canada is a non-profit Amateur Athletic Organization.  At Maccabi Canada we work to develop and promote a Jewish identity in our youth so they can become the future leaders of our community.   We achieve our goal through the passion of sports.

The Maccabiah Games are a prominent international Olympic style sports competitions, held every 4 years in Israel, Europe and South America.  Locally, Maccabi Canada provides sports skill development programs for children and youth and educational programs to the community.

Maccabi Canada is a member of Maccabi World Union, the largest Jewish organization in the world with over 450,000 registered members world-wide.

  1. All parties to this Agreement will promote fair play and honourable and ethical conduct by players, parents, coaches, volunteers and team management.
  2. As a Staff Member, you will be communicating with athletes, participants, volunteers, parents, staff members, other coaches or other third parties.  You will be an extension of the Maccabi Canada organization, and therefore agree to represent Maccabi Canada positively, respectfully and in accordance with the Maccabi Canada goals. 
  3. As a Staff Member you will work professional and respectfully with the volunteer organizing committee including Maccabi Canada’s Executive, board members, sports chairs, team leads (medical, communications, logistics, etc)  and office staff and adhere to Maccabi Canada’s guidelines and protocols
  4. As a Staff Member, you will be responsible to fulfill your roles and responsibilities as outlined in your role’s guideline, attached hereto as Appendix “A”.
  5. As a Staff Member, you will receive Maccabi Team apparel. Staff Members are required to wear Maccabi apparel at all Maccabi events, including practices, games, parents meetings, fundraising events, and any other Maccabi Canada engagement, in order to be identified as a part of Maccabi Canada.
  6. If required Maccabi Canada will provide Staff Members with the athlete’s contact information, with the understanding that information privacy will be maintained and that participants will not be contacted or solicited for non-Maccabi purposes, nor will this information be shared with anyone.
  7. In the event that you, as a Staff Member are unable to complete your commitment, Maccabi Canada requires a written notice 6 months prior to departure.
  8. Maccabi Canada reserves the right to terminate this agreement at any time and for any reason whatsoever and at its sole discretion by providing the Staff Member with written notice, to be effective immediately.
  9. Maccabi Canada does not authorize the coach or Staff Member to transport participants in a rented or private vehicle at any time. In the event of an emergency the coach or staff will not transport a participant unless the driver maintains adequate automobile insurance in a vehicle rented or operated by the Coach, and will maintain the proper classification of a drivers licence. 
  10. The Staff Member agrees to submit a Police Background Check to be completed by Sterling Talent Solutions and sign and abide by the Maccabi Canada Code of Conduct, attached hereto as Appendix “B”.
 
RELEASE AND WAIVER OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT.
BY SIGNING THIS AGREEMENT YOU WILL WAIVE CERTAIN LEGAL RIGHTS.
PLEASE READ THIS DOCUMENT CAREFULLY.
I, the "Staff Member", acknowledge and agree that in consideration of being permitted to participate in the Maccabi Games Program and related Activities arranged, organized, sponsored, conducted, authorized, staged and/or operated by Maccabi Canada:


1.      I HEREBY ACKNOWLEDGE AND AGREE THAT:
  • The Maccabi Games Program and related Activities may be dangerous, exposing myself and others to many risks and hazards, some of which are inherent in their very nature, others which result from human error and/or negligence on the part of the persons involved in arranging, organizing, sponsoring, authorizing, conducting, staging and/or operating the Maccabi Games Program and related Activities;
  • The Maccabi Games Program or related activities (including travelling to or from such Program or Activity) can be an extreme test of a person’s physical, emotional and mental limits and carries with it the potential for death, serious injury and property loss. The risks include, but are not limited to: actions of other people including, participants, volunteers, spectators, coaches, event officials, event monitors and/or producers of the event; lack of hydration, weather, and/or other natural conditions. I hereby assume all of the risks of participating in the Games or or related activities
  • I certify that I am physically, emotionally and mentally fit and have not been advised otherwise by a qualified medical professional;
  • I willingly agree to comply with the customary terms and conditions for participation. If I observe any unusual significant hazard I will remove myself and others from participation and bring such to the attention of the nearest Games representative immediately;
  • I understand that neither Maccabi Canada  nor any of its directors, officers, employees, volunteers, sponsors, independent contractors or agents assume any responsibility whatsoever for my safety during the course travelling to and from, or my preparation for or participation in the Maccabi Games Program and related activities;
  • I understand that I may be photographed and  agree to allow my photo, video, or film likeness to be used for any legitimate purpose by Maccabi Canada;
  • I hereby consent to receive emergency medical treatment that may be deemed advisable by a medical professional in the event of injury, accident, and/or illness during the Maccabi Games Program and  related activities;
  • I nevertheless freely and voluntarily assume all the aforesaid risks and hazards, and that, accordingly, including traveling to and from, my preparation for, and participation in any Maccabi Games Program and related activities shall be entirely at my own risk;
2.      I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, hereby to the greatest extent permitted by law, RELEASE, HOLD HARMLESS AND INDEMNIFY Maccabi Canada and its directors, officers, employees, volunteers, sponsors, independent contractors and agents (collectively “the Released Parties”) from all liability, and all recourses, proceedings, claims, and causes of action of any kind whatsoever, present or in the future, in respect of any and all personal injuries or property losses which I may suffer arising out of or connected with travelling to and from or my preparation for, or participation in the Maccabi Games Program and related activities notwithstanding that such injuries or losses may have been caused solely or partly by the active or passive negligence or breach of duty of Maccabi Canada or any of their directors, officers, employees, volunteers, sponsors, independent contractors or agents.

I also recognize and agree that the Released Parties assume no responsibility for any liability, damage, or injury that I might sustain due to the intentional, unintentional or negligent acts or omissions of any other person or organization.

3.      Governing Law

This Agreement shall be construed, interpreted and enforced in accordance with the laws of the Province of Ontario, Canada.

4.      Severability

If any provision of this Agreement or its application to any Party or circumstance is determined by a court of competent jurisdiction to be illegal, invalid or unenforceable, it will be ineffective only to the extent of its illegality, invalidity or unenforceability without affecting the validity or the enforceability of the remaining provisions of this Agreement and without affecting its application to other parties or circumstances.

5.      Acknowledgement of Understanding

I have read this Release Waiver of Liability, Assumption of Risk, and Indemnity Agreement, and fully understand its terms and conditions.
