Advocacy Topics

Below are UPPO Government Relations and Advocacy Committee (GRAC)'s chief initiatives during the past year. A few of the topics will be discussed during the GRAC general session, Advocacy Efforts in the Age of Reform, at the 2018 Annual Conference, Tuesday, March 6 at 9:15 a.m.

ABA Model Act
UPPO provided comments on new model unclaimed property act drafted by American Bar Association. The American Bar Association has not affirmatively endorsed the Uniform Law Commission’s 2016 Model Act, but instead has drafted its own version of a uniform unclaimed property act.  It is anticipated that this act may be a counterpoint in legislative discussions on reforming state unclaimed property laws and the GRAC session would include a review of the key provisions in the Model Act that differ from the 2016 Revised Uniform Unclaimed Property Act (“RUUPA”).

Delaware DOF Final Regulations
UPPO provided comments on new legislation and on regulations issued by Delaware. Beginning in early 2017, Delaware overhauled its unclaimed property law and both the Department of Finance and the Secretary of State office issued regulations interpreting sections of the new law. UPPO drafted comments to the proposed legislation and administrative regulations.  The success of that effort and ongoing discussions with Delaware officials would be discussed during the GRAC session.
 
RUUPA-Influenced Legislation
Legislative activity has taken place in Illinois, Tennessee, Utah, Nebraska, Minnesota and Maine. The discussion at the GRAC session would focus on how this legislation (and recently enacted laws) compare to the ULC model act and specific nuances that seem to be appearing in legislation that are not in the RUUPA.  Strategy for advocacy on future anticipated RUUPA influenced legislation and ideas for being proactive would be discussed.
 
Nevada Reporting Challenges
UPPO members have expressed frustration with reporting UP in Nevada. UPPO has had discussions with Nevada representatives regarding several issues including consolidated reporting, report upload issues, etc. An explanation of these issues and UPPO’s efforts to work toward a solution would be outlined during the GRAC session. 
 
Holders Coalition Participation
During the past few years UPPO has participated in a relatively new group called the Holders’ Coalition. This Coalition is comprised of several trade organizations, law firm representative, holders, etc. UPPO has taken on the role of facilitating the Coalition meetings. The GRAC session would include information regarding how UPPO has collaborated with the Coalition member organizations to educate legislators/officials and advocate for the interests of holders and owners.
