The following form is to be used by businesses in Greater Sudbury interested in using outdoor spaces for commercial activity such as restaurant patios and sidewalk retail sales. 

Please note: Those businesses with existing built-in patios and approved Liquor Licenses in place are able to proceed with reopening as of Friday, June 12, without any additional approvals required from the City. They will need to follow public health requirements for their staff and clients in terms of operating a COVID-safe establishment, including physical distancing measures, and cleaning and disinfection protocols

Please refer to the Temporary Use of Outdoor Spaces Guidelines for more information, and complete the following online form.  Attach appropriate documentation (certificate of insurance & sketch 'DONE TO SCALE' of proposed location and layout to allow for physical distancing) below as outlined in the application form. 

Should a business wish to use tents for patio and outdoor commercial space, as in accordance with the Ontario Fire Code, they must be flame-proofed before erecting.  Additionally, any tents larger than 646 sq. ft. requires a building permit. 


Your Site Layout, which must show physical distancing between groups, will be reviewed by the Patio Application Review Team.  If the site layout meets the specified requirements the application will be approved in principal with final acceptance resting on the applicant receiving an outside liquor license. 

There are no municipal fees associated with patio applications for the 2020 season. 

If a Fire Route is occupied by an Outdoor Space, a suitable alternate Fire Route must be delineated.

Outdoor Spaces may extended across an adjacent business frontage if written permission is provided by the owner/operator of the adjacent business.

It is the responsibility of the Applicant to meet all licensing requirements that would normally be required to operate their business (Fire Services, Public Health, AGCO, etc.) and provide confirmation of same. 

Note that Provincial Regulations ban smoking on all outside Patios and or Sidewalk Cafes.
