Resolution Survey

The purpose of this survey is to poll the residents of Brighton Township regarding the future of Sunset Park & Sunset Estates located on the NW corner of Kensington & Buno roads. The results of this survey will be shared with the BT Board of Trustees as the voice of the residents.

The current owner (Clearwater) of the previous gravel pit (Sunset) purchased the land with recorded covenants of a Joint Planned Development Agreement (JPDA) to develop Sunset Park & Sunset Estates. After attempting to convert the property back into a gravel pit, the township sued Clearwater for failing to comply with the JPDA. Since then, Clearwater stated they have no money to develop the JPDA and will need to operate as a gravel pit and mine for up to 20 years in order to generate the money by extracting and filling to develop the obligation.

The Brighton Township Board of Trustees will be voting soon on options to resolve the dispute with Clearwater; A) Allow the appointed county arbitrator to decide on the enforcement of the JPDA,  or B) Settle with Clearwater with strict requirements.

This resolution will be critical in preserving our drink water, safety, rural setting, property values, and ultimate usage of our tax dollars for a township park as described in this Impact Study.

This survey is supported by the Brighton Township Homeowners Association. The purpose of this association is to establish a closer relationship and cooperation with the township, county and state governments for the betterment of the community; to promote cooperation between homeowners for the common good; to exert an influence for good on the life of the community and to cultivate a spirit of brotherhood and good fellowship amongst its members; and to promote citizen participation in the community.

This association has been supported by resident contributions to sustain incorporation fees, legal fees, bank fees, and application fees.
