In February 2021, the Washington State Supreme Court ruled in State v. Blake that the state's felony drug possession statute was unconstitutional, prioritizing treatment over penalty for those suffering substance use disorder. This year, the Legislature is working on a package response offering pathways to recovery while balancing public safety.
There are four current proposals:
SB 5467 - encourages substance use treatment for possession, and requires a jail sentence if individuals do not comply with treatment.

Blake that the state's felony drug possession statute was unconstitutional, prioritizing treatment over penalty for those suffering substance use disorder. This year, the Legislature is working on a package response offering pathways to recovery while balancing public safety.
There are four current proposals:
SB 5536 - Penalizes possession of a controlled substance as a gross misdemeanor, creates a diversion program for those charged with possession, and allows individuals to vacate possession convictions if they successfully complete substance use disorder treatment
