Re: Adoption of NASAA Statement of Policy Regarding Real Estate Investment Trusts as amended September 7, 2025

The Washington Securities Division is considering amending WAC 460-16A-205(1)(e) to adopt the NASAA Statement of Policy Regarding Real Estate Investment Trusts (“2025 Statement of Policy”) as amended by NASAA on September 7, 2025. The Securities Division currently applies the version of this Statement of Policy amended on May 7, 2007 (“2007 Statement of Policy). View a copy of the 2025 Statement of Policy.

To determine the economic impact of the possible adoption of the 2025 Statement of Policy, we are conducting a survey of all real estate investment trusts (“REITs”) registered or pending registration in Washington.
