Reporting to Police Policy

SHARE YOUR FEEDBACK:
The College of Respiratory Therapists of Ontario (CRTO) regulates Respiratory Therapy in the public interest. As part of this mandate, the CRTO must ensure that appropriate follow-up occurs when information comes to its attention that may indicate criminal conduct. The Reporting to Police Policy provides the public and CRTO Members with a transparent understanding of the CRTO’s obligations when information is received regarding the alleged conduct or actions of a Respiratory Therapist. It also clarifies the authority on which the Registrar may rely when reporting information about a Member to the police in circumstances where the Registrar is of the opinion that the Member’s conduct or actions may be criminal in nature.

Summary of Changes
  • A thorough review of the policy was completed to ensure that the information is presented in clear, plain language that is accessible and understandable to CRTO Members and the public.
  • Further clarity was provided in the “Applicability” section to clearly identify the specific circumstances in which the policy applies.
  • Under the “Considerations” section, the three-criteria test was revised by removing the third criterion. It was determined that retaining the third criterion could unnecessarily limit the Registrar’s ability to provide information to the police. There may be circumstances in which the first two criteria are met (that is, the conduct appears to be criminal in nature and there is a risk to the public), but the CRTO does not have additional information beyond the conduct itself to provide to the police. Under the current policy, the absence of additional information would prevent the CRTO from disclosing information to the police in these circumstances.
  • Under the “Related Documents” section, the newly developed “Procedure for Disclosure of Information to System Partners” was added to provide additional guidance regarding the disclosure of information to system partners.
