Right now, NSW is unnecessarily restricting access to donor sperm — making it harder for people across the state to create the families they’ve always dreamed of.

Under NSW law, ART providers cannot treat a woman if doing so would result in a donor’s offspring being born to more than five “women”.

Historically, NSW clinics have understood this as a limit applying within NSW and structured their donor programs accordingly.

But late last year, NSW Health changed its position, interpreting the limit as applying worldwide — fundamentally changing the way the law is being applied.

This change is already affecting people trying to start or grow their families, and could affect many more in the future.
