Electronic Voting Procedure

In accordance with the Virginia Property Owners’ Association Act (POAA), 55.1-1832 “Use of Technology”, otherwise known as electronic voting, is an approved method to accomplish voting. Please complete the below voting ballot to submit your vote. Only one vote per Lot Owner will be recorded.

* 1. Amendments to the community’s covenants and restrictions require seventy-five percent (75%) of Lot Owners to agree. In other words, for any amendment to pass, 210 out of 279 lots must approve.

Should the percentage required to pass an amendment be lowered to 65%?

* 2. In reference (b), Exhibit 1, Protective Covenants and Restrictions, states that no fence shall exceed four and one-half feet in height, with the exception of fencing required by Fairfax County Code for tennis courts and swimming pools which may exceed the covenants provisions. A recent survey of existing fences in the community showed a fair amount of six-foot fences, and the recent survey indicated community interest in amending the existing covenants to raise the allowable fence height to six feet. Any proposed fence installation regardless of height requires Architectural Review Committee (ARC) approval to ensure other fencing requirements (e.g., nothing along front property line, no chain links) are adhered to.

* 3. The Architectural Standards and Guidelines, which were developed from a review of reference (b), Exhibit 1, Protective Covenants and Restrictions, states that sheds/storage buildings are not allowed. The recent survey indicated community interest in amending the existing covenants to allow sheds. If approved for incorporation into the Architectural Standards and Guidelines, approval of shed requests will be conducted via the standard ARC process. The Architectural Standards and Guidelines will be updated to prescribe expectations for the appearance of sheds to be in keeping with the general community aesthetic. Homes with sheds already in place will be grandfathered in even if outside of the draft guidelines. However, once a grandfathered shed requires replacement, it must be replaced with a shed that meets ARC guidelines. Should sheds be authorized, contingent upon updated Architectural Standards and Guidelines that prescribe specific requirements (e.g., size limitations, color schemes, placement locations), and approval through the standard Architectural Review Committee (ARC) process?
