The Oregon Board of Pharmacy is seeking public feedback on proposed Pharmacy Prescription Locker (PPL) rules. Please review each proposed rule and provide feedback in the comment boxes below each rule. We suggest reviewing questions #1 through #9 first and then going back to question #1 to provide your feedback.

The Board anticipates reviewing the public feedback received as well as the proposed rules during the June 11-12, 2026 Board Meeting.

Purpose and Scope

The purpose of OAR 855-143 is to provide minimum requirements for a pharmacy to operate a Pharmacy Prescription Locker (PPL).

Definitions

(1) The following words and terms, when used in OAR 855-143, have the following meanings, unless the context clearly indicates otherwise. Any term not defined in this section has the definition set out in OAR 855-006.

(2) “Pharmacy Prescription Locker” or “PPL” pursuant to ORS 689.338 means a mechanical device that serves as an extension of an Oregon registered Retail Drug Outlet’s will call or point of sale area in which completed patient-specific prescription drugs, devices and related supplies and nonprescription drugs, devices and related supplies are stored for pickup.

General Requirements

(1) A pharmacy that has a PPL must:

(a) Follow all applicable pharmacy requirements in statute and rule;

(b) Follow all applicable federal laws and rules;

(c) Disclose, as part of the pharmacy’s initial application and renewal if the pharmacy has a PPL and where each PPL is located;

(d) Receive patient permission prior to placing a prescription in a PPL; and

(e) Ensure a PPL displays required patient notification as follows:

(A) Per OAR 855-041-1035(1)(g)-(h);

(B) Per ORS 689.615;

(C) Pharmacy contact phone number and pharmacy hours of operation for patient assistance; and

(D) Patient notifications via signage on the PPL or through an electronic video monitor that requires the patient to acknowledge their review and understanding prior to retrieving medication from a PPL.

(2) The pharmacy and the Pharmacist-in-Charge (PIC) must ensure:

(a) Drugs are stored and maintained pursuant OAR 855-41-1035 and OAR 855-41-1036;

(b) Only a licensee stocks and removes contents from a PPL; and

(c) A pharmacist supervises, directs and controls all PPL processes including but not limited to the stocking, the removal of contents and maintenance of a PPL.

(3) The pharmacy may store drugs, devices, and related supplies together in a PPL. Anything that is not a drug, device or related supply must be stored in a compartment separate from a drug, device or related supply.

(4) The PIC must ensure a pharmacist completes a physical inspection of a PPL annually as part of their self-inspection of the pharmacy as required in OAR 855-115-0210(1)(h).

(5) The pharmacy may return to stock PPL drugs, devices and associated supplies that were not picked up by a patient or patient’s agent and were stored and handled in compliance with these rules.

(6) The pharmacy may allow a patient or patient’s agent to pick up their drug, device or related supplies from a PPL when a pharmacist is not physically present at the pharmacy.

The pharmacy and the PIC must ensure a PPL:

(a) Utilizes appropriate security measures and monitoring of inventory to prevent theft and diversion;

(b) Prevents unauthorized access;

(c) Maintains confidentiality of patient information; and

(d) Correctly dispenses prescriptions.

Outlet: Technology

(1) A pharmacy must ensure a PPL utilizes a shared computer system and has appropriate technology or interface to allow access to information required to dispense prescription and non-prescription drugs, devices, and related supplies.

(2) A pharmacy must test a PPL and verify the unit is operable and functioning in all aspects prior to its initial utilization.

(3) A pharmacy must develop, implement and enforce a plan for routine maintenance of the PPL.

(4) A pharmacy must develop, implement and enforce a plan for identifying, responding to and recovering from an interruption of service.

Policies and Procedures

(1) The pharmacy and the PIC are accountable for establishing, maintaining, and enforcing written policies and procedures for the pharmacy in compliance with federal and state regulations. The written policies and procedures must be maintained at the pharmacy and must be available to the board upon request.

(2) The pharmacy must adopt the following policies and procedures:

(a) All policies and procedures required in Division 41 to be specific to the PPL;

(b) Technology utilization;

(c) Operations;

(d) Detection and mitigation of diversion and theft;

(e) Prescription storage inclusion criteria;

(f) Determining access;

(g) Patient permission and communication;

(h) Stocking and removing contents;

(i) Record creation and maintenance;

(j) Equipment maintenance; and

(k) Storage of items that are not a drug, device or related supply.

(a) Pharmacist physical inspection;

(d) Records of stocking and removal of contents must include the:
