Updated Regulations

Registration Application Form for Registration of Solid Fuel Producers under Regulation 6 of the Air Pollution Act 1987 (Solid Fuel) Regulations 2022 (Statutory Instrument No. 529 of 2022).
The Regulations require, among other things, solid fuel producers to:
 
1. Register with the Environmental Protection Agency annually before September 1 each year
2. Provide the Environmental Protection Agency with information it may reasonably require for the purposes of fulfilling its functions, and
3. Provide a valid Certificate of Compliance from a third-party certification body to verify solid fuel complies with the technical standards set out in Regulation 5 and as detailed in Regulation 10. A copy of the Certificate of Compliance must be submitted separately to the EPA at fuelregistration@epa.ie. 


Under the Regulations, it is prohibited to retail or distribute solid fuel for the purposes of combustion for heating (space or water) in a fireplace in a domestic or a licensed premises that is not an approved solid fuel.

To be approved a solid fuel must adhere to the relevant requirements
 
1. Coal products and manufactured solid fuels must have a smoke emission rate of less than 10 grams per hour
2. Manufactured part biomass products must have a smoke emission rate of less than 5 grams per hour.
3. Coal products and manufactured solid fuels, including manufactured part biomass products, must have sulphur content less than 2% by weight on a dry ash-free basis, and, subject to market assessment, with effect from 1 September 2025, have sulphur content less than 1% by weight on a dry ash-free basis.
4. Fuel products which are 100% biomass products, including wood products and wood logs, supplied in units of two cubic metres or less, must have a moisture content of less than 25%, and from 1 September 2025, less than 20%.
Failure to provide a completed Fuels Registration Application Form in full and a valid Certificate of Compliance will result in refusal of the application.
