Current penalties for littering in Marion County

Per Sec. 16-91 of the Marion County Code of Ordinances:

Those who litter are guilty of a noncriminal infraction, punishable by a civil penalty of:

·         $50 for the first violation
·         $250 for the second violation
·         $500 for the third violation

The fourth and all subsequent violations of Marion County’s litter ordinance shall constitute a second-degree misdemeanor and are punishable by:

·         A $500 fine and
·         Up to 10 days’ imprisonment or community service time as prescribed by the Florida Litter Law.

Those who dump litter in an amount exceeding 500 pounds or 100 cubic feet in volume, or in any quantity for commercial material, or a substance deemed hazardous waste by the Florida Statutes, is guilty of a third-degree felony punishable by:

·         Up to 5 years in state prison and
·         A $500 fine and a $5,000 fine.
