PFAS Removal and Disposal Survey

Program: As directed by the Maine Legislature (L.D. 400), beginning on November 1, 2025, the Maine Office of the State Fire Marshal (FMO) will launch a statewide effort to identify and inventory all aqueous film-forming foam concentrate (AFFF) that contains per- and polyfluoroalkyl substances (PFAS, also known as “forever chemicals”) stored in amounts of 5 gallons or more.

Purpose: This statewide inventory will support the Department of Environmental Protection in creating a take-back program to arrange for no cost collection and safe disposal of firefighting foams from public or private entities that voluntarily request it, preventing environmental contamination. PFAS are man-made chemicals with strong bonds that resist breaking down, allowing them to accumulate in people, animals, and the environment. Research has linked PFAS exposure to increased cholesterol, thyroid disruption, liver impacts, developmental issues, immune suppression, and higher risks of certain cancers. If PFAS-containing foam leaks into the environment, it can contaminate soil and water.

Public Entities: Public entities—including state agencies, municipalities, fire departments, and other government organizations—must report their AFFF holdings during a one-year reporting program and submit information no later than November 1, 2026. However, expect that the FMO will move sooner to compile this information.

Private Entities: Private entities—including businesses, industrial facilities, and other non-government organizations—will be asked to provide the same information through a two-year reporting program and will be required to submit information no later than November 1, 2027.

The information gathered will be compiled into a comprehensive statewide inventory to ensure safe management of PFAS-containing firefighting foams and to support the transition away from these harmful chemicals. The State Fire Marshal is required to submit a report to legislature by January 1, 2028. All information obtained will publicly be made available on the Office of the State Fire Marshal website.
