ACHA are reviewing our CCTV and Video Doorbell Policy (Tenant use). We are seeking your views on the proposed new draft policy.
It is important that key policies are reviewed regularly to ensure that they are up to date with and comply with best practice and current legislation. ACHA’s current CCTV policy was written in 2015.

* 1. ACHA recognises that video doorbells and CCTV are becoming very popular with the technology now being cheaper and more readily available. They add an extra level of security to a home and ACHA want our tenants to feel safe in their homes. For this reason ACHA will not stop our residents installing CCTV or video doorbells and we will not require our tenants to ask for permission to install these items as they are not permanent fixtures.

* 2. Whilst we believe it is our tenants right to install CCTV and/or video doorbells to improve the security of their home we do expect them to be used responsibly, in line with the law and with respect to neighbours. For this reason ACHA will provide residents signposting to information regarding their responsibilities when using video doorbells and CCTV. The relevant information will be given out to our tenants at sign up, if they make enquiries regarding CCTV and video doorbells and also on our website.

* 3. If a member of the public or neighbour has a concern about the use of the video doorbell/CCTV or the improper use of the data captured they should report this to the Police for them to carry out enquiries with the data controller/data processor. If they are not satisfied with the Police response then they should escalate their concern to the Information Commissioners Office for them to advise on. If they remain dissatisfied, then they should raise their own private or civil action. As a Landlord It is not ACHA’s responsibility to deal with complaints regarding the collection and use of data.

* 4. ACHA has a duty to investigate reports of Anti-Social Behaviour and/or harassment and will offer advice, guidance and consider any tenancy enforcement actions as part of the response. This applies to where we receive a complaint that CCTV is being used to cause harassment or Anti Social Behaviour. However claims of harassment or Anti-Social Behaviour by inappropriate use of video doorbells/CCTV must be supported by evidence of specific incidents. General dissatisfaction that a neighbour has and is using a video doorbell/CCTV is not considered anti-social behaviour or a breach of tenancy and ACHA will not take action.

The Data controller and or Data processor (the person who has put up the CCTV/video doorbell that is taking in a public or common area) is responsible for any Subject Access requests made by members of the public, neighbours and agencies who have requested access to the images, audio and data captured by the video doorbell/CCTV. If a member of the public, neighbouring resident or agency require access to the images audio or data captured by the video doorbell/CCTV of one of our tenants ACHA cannot request access to that information on behalf of that person or agency.
