No Surprises Act Survey 2023

Tell us your experiences with the No Surprises Act.

Thank you for sharing your experiences to date regarding the No Surprises Act (NSA). ASA is collecting the key issues anesthesiologists are facing in payer negotiations and Independent Dispute Resolution processes.

The information we receive from you will be used to advocate to policymakers and develop resources to support anesthesiologists as they navigate their way through the NSA process.

Thank you in advance for sharing your NSA experiences.

Important to Note:
Do not send specifics on rates or other protected information. ASA has no desire to have antitrust conversations with the Department of Justice or the Federal Trade Commission.
1.Since January of 2022, has your practice experienced any changes with any insurance payer from in-network to out-of-network status?
2.If you are out-of-network with any payer, have you experienced any problems with navigating the No Surprises Act?
3.ASA has been pushing the key federal agencies to hold payers accountable for accurate insurer Qualifying Payment Amounts (QPA), including supporting a federal lawsuit. Have you observed reasonable insurer QPAs?
4.In cases in which you have prevailed in the No Surprises Act Independent Dispute Resolution (IDR) process, have your payments from insurers and refunds from the IDR entities occurred within the required 30-day period?
5.ASA has been pushing the key federal agencies to permit practices to batch all their disputed anesthesia claims, regardless of CPT code, from the same issuer for IDR consideration. Would this help your practice more effectively contest disputed claims?
