Terms and Conditions

Please read through the ECP General Terms and Conditions, and the ECP Summer Club Terms and Conditions.  By submitting this form, you agree to adhere to these Terms and Conditions.

General
1 Definition of terms and conditions:
“ECP” - the Mt Rox Limited T/A East Coast Paddler Stand Up Paddle Boards company, its staff and activities.
“ECP Activities” - all activities under the guidance ECP.
“Summer Club” - Membership to participate in the ECP Activities as laid out in the ECP
Summer Club promotion for the period immediately following the signing of the contract.
“ECP staff” - instructors, assistants and management employed by Mt Rox Limited.
2  WARNING - Participating in ECP Activities can be inherently dangerous.  Due to the
nature of ECP Activities, serious accidents can happen which may result in being
seriously injured or even killed.  Agreeing to these terms and conditions means one has
read and understood this warning and accept the inherent risks in participating in any
ECP Activities.
3  PHYSICAL FITNESS - Any injury, disability, medical or health condition that may
increase the risk of harm whilst participating in any ECP Activity must be declared. 
Members must be medically and physically fit and able to participate in the ECP
Activities, and immediately notify ECP of any changes in fitness and ability to participate.
4  INSTRUCTION - Members must at all times comply with the instructions and safety
guidelines of the ECP staff.
5  MEDICAL TREATMENT - If required, the ECP staff will arrange medical or hospital
treatment (including transportation).  Members must agree to such actions being taken
by ECP staff and agree to meet all costs associated.
6  RELEASE AND INDEMNITY - Participation in the ECP Activities is entirely at the
member’s risk who must agree to:
   a  Release and forever discharge ECP from all liability and claims but for this release
arising from or in connection with participation in the ECP Activities.
   b  Indemnity and hold harmless ECP to the extent permitted by law in respect of any
claims by any person including but not only another participant in the ECP Activities
arising from participation in the ECP Activities.

In this clause 6 “claims” means and includes any action, suit, proceeding, claim demand, damage, penalty, cost or expense however arising (including negligence, trespass to the person or for breach of implied terms in The Fair Trading Act 1986).

7  IDENTITY - Photographic and/or visual images taken by ECP Staff of participation in
the ECP Activities may be used for general purpose promotion of ECP.
8  PRIVACY - The personal information provided by members is necessary for the
operation of the ECP Activities.  Members acknowledge and agree that the information
will only be used for the objectives of ECP and to provide members with relevant
information pertaining to the ECP Activities.  Members understand that they will be able to access personal information through ECP upon request.  If members do not provide
the information required by ECP, members understand that they may not be permitted to participate in the ECP Activities.
ECP Summer Club
  1. The ECP Summer Club members are eligible to receive the following during the agreed season as listed on the registration form:
    1. 10 x 1 hour board and equipment hires
    2. Entry to any SUP Fitness class
    3. Entry to any local tour
    4. Member only discount on all SUP retail items
    5. Member only discount on all other ECP events
  2. Members are required to provide their own board, leash, personal floatation device and paddle for all activities available to ECP Summer Club members, except for any complimentary board hires included. Members can hire ECP equipment for $10, subject to availability.
  3. Members must 16 years of age or older.
  4. General location for most ECP Activities is Pilot Bay, Mt Maunganui, but may vary from time to time. Members must find own transport to ECP Activity locations.
  5. There are limited entries to fitness class and local tours. Bookings are essential.
  6. The 10 x 1 hour board and equipment hires can be gifted by the member to other people. The member must notify ECP Staff prior to the gift being redeemed.
  7. The activities available to ECP Summer Club members are to be used by the registered member only.
  8. Payment of $299, or otherwise as arranged with ECP Staff, is to be paid in full by 1 December 2017. Members are able to pay in instalments. There will be no refunds or payment holidays granted after payment is made.
  9. ECP Summer Club season 2017-2018 starts 30 September 2017 and ends 29 April 2018.
  10. ECP Activities will be rated in level of difficulty. Definition of levels can be found on the website eastcoastpaddler.co.nz and it is the member’s responsibility to be informed and choose the appropriate activities to partake in.
