FUAN (CRC)-Custodial Reform Committee Application

(CRC) Purpose Statement:
To preserve and protect children & families through lobbying efforts and strategy committee work toward creating shared parenting, limiting effects of PSA, creating true maximum time, and other various divorce reform efforts for Iowa's Families and for the next generations.

This closed group is for truly active members who are dedicated to doing research, making decisions, delegating, compromising, and setting forth clear and concise messages, declaring plans of action to move the Divorce Law Reform topic further ahead in Iowa legislation & beyond, setting realistic and achievable deadlines, communicating with the other committees to create full Family Law Reform agenda messages, and to dare to create a vision for the future that truly is in the best interest of the children and family preservation.

This committee is focused on legislation within Iowa, but there will still be many members from out-of-state whose presence will be to assist in information sharing, and precedent setting to help us all move further along in the Family Law Reform agenda.

WHAT WE NEED FROM THIS GROUP..

Families United Action Network's Custodial Reform Committee (CRC) has many issues and topics in which to create concise and clear messages one piece at a time explaining/communicating the needed changes in the family law divorce court system in order to help draft new legislation. Therefore, we ask that each of you follow the steps for joining the page:
1. Review this pin post with the page description and group rules.
2. Find the thread with the picture "Who are you," and give us an introduction of who you are. 
3. Join our subcommittees by placing a comment in the subcommittee of choice thread. (You may join multiple subcommittees).
4. Abide by all of our group rules Insert link.
5.  Commit to the 15 minutes per day average time on Family Law Reform Projects.  (Note:  Keep track of your time to submit a quarterly recap for a tax deductible donation.)
6.  Share information, join/participate in discussions, put forth solutions/ideas, and work as a team to correct these family law reform issues. Information may be shared freely throughout the page, but we ask that you try and keep the posting in the relevant subcommittee. Note that your post might be moved to a subcommittee or archived at the end of each month. Archives can be accessed by request through the (DRC) leadership.

Custodial Reform Committee -Subcommittees include:
Due to the wide variety of topics and people's passion towards each topic, we would suggest a key leaders/spokesman for each of the topics listed below.
1. Shared Parenting Advocacy & Legislative Strategy Work group/subcommittee.
2.Biological parent rights, regardless of gender, work group/subcommittee.
3. Reform proposals regarding visitation orders affecting parents and/or extended family members work group/subcommittee.
4. Awareness of judicial overreach work group/subcommittee.
5. Attorney activism to include Bar Association outreach work group/subcommittee.
6. Servicemen and women divorce related issues workshop group/subcommittee.
7. Iowa Alimony/Child Support Reform subcommittee.
8. Parental Alienation / (PAS) subcommittee thread.
9. Discussions on title IV funding, and solutions of how to correct this obviously broken system.
10.  Visitation enforcement.

RECIPROCAL CONFIDENTIALITY AGREEMENT (Part A)

THIS CONFIDENTIALITY AGREEMENT ("Agreement") is made and entered into as of the date ascribed below, by and between Families United Action Network (hereinafter “FUAN”) and _____________________________________________________, hereafter referred to as “the Parties”, with regard to the following facts:

RECITALS

A. The Parties intend to enter into discussions regarding activities concerning the furtherance of the purposes of FUAN as stated in FUAN’s bylaws and any other documents, in any form, which relate FUAN’s missions, rules, or methods of operation.

B. Each Party possesses certain ideas and information, relating to the above purpose, that are confidential.

C. Both Parties desire to preserve and protect the confidential nature of their own and each other's Confidential Information upon the terms and conditions set forth herein, including, but not limited to, personal information of any Party or Party’s representatives, i.e., name, address, physical or electronic address, telephone numbers, or other identifying personal information of any type.

NOW THEREFORE, in consideration of the foregoing, the Parties agree as follows:

AGREEMENT

1. Confidential Information. Each Party acknowledges and agrees that it may, at the other's sole discretion, have access to certain information of the other and/or the other's affiliates that is generally not available to or known by the public, and that has particular value to the other, and the disclosure of which could be harmful to others' interests (the "Confidential Information"). Such Confidential Information may include, but is not limited to, information and knowledge regarding communications, procedures, processes, strategies and programs, financial data, vendor and customer relationships, business and marketing plans, collaborator relationships, joint-venture relationships, methods of operation and other proprietary information or materials in any form (including, without limitations, in electronic media).

2. Disclosure and Use of Confidential Information. Each Party covenants and agrees that it will:

A. not disclose any Confidential Information of the other to any person or entity without the express prior written authorization of the other; and

B. not use any Confidential Information of the other for any purpose whatsoever other than strictly in connection with the potential purposes described above.

Each Party acknowledges and agrees that all Confidential Information of the other is and will remain the sole and exclusive property of the other. Each Party covenants and agrees that the restrictions and obligations upon it concerning Confidential Information shall pertain to all its members and third parties associated with it including, but not limited to, advisers, agents and independent contractors. Each Party agrees to use its best efforts and due diligence to ensure that all such members and associated parties comply with the terms of this Agreement. Reproduction by one Party of any written Confidential Information of the other is prohibited, except as is expressly permitted in writing by either Party.

3. Continuing Effect and Scope. All obligations pursuant to this Agreement shall end five (5) years after the date of this Agreement. In addition, no obligations under this Agreement shall apply to any portion of a Party's Confidential Information that:

A. is known to the other Party through authorized or proper means prior to receipt thereof under this Agreement, as evidenced by written or other tangible records, or is disclosed without restrictions to the other Party in good faith by a third Party who is in lawful possession thereof and who has the right to make such disclosures;

B. is or shall have become public knowledge, by publication or otherwise, through no fault of the other Party;

C. is independently and lawfully discovered by the other Party completely without reference to such Confidential Information, as evidenced by written or other tangible records; or

D. is required by law to be disclosed.

4. Return of Information. Upon the request of either Party, each Party shall return all Confidential Information received in written or tangible form, including copies, or reproductions or other media containing such Confidential Information, within ten (10) days of such request. In the event that the relationship between the Parties shall cease, for any reason, each Party shall immediately return to the other all Confidential Information received from the other.

5. Enforcement. This Agreement shall be binding upon each Party. The Parties agree that either Party may, on an ex-parte or noticed basis, obtain a preliminary injunction or other injunctive relief to enforce and preserve rights under this Agreement. Nothing herein shall be construed as prohibiting a Party from pursuing any other available remedies for breach or threatened breach of this Agreement.

6. Controlling Law. This Agreement shall be governed by the laws of the State of Iowa. This Agreement may be amended only in writing signed by both of the Parties. The Parties agree that the invalidity of any part of this Agreement shall not affect the validity of the remainder of the Agreement.

7. Entire Agreement. This Agreement constitutes the entire agreement between the Parties hereto, and supersedes all other prior agreements, understandings, representations and promises, oral or written, with respect to the subject matter hereof.
