Summary of the proposal:

The Fire and Emergency New Zealand Act 2017 (FENZ Act) has established a new agency, Fire and Emergency New Zealand (FENZ) which is responsible for fire safety, including setting fire bans and issuing fire permits (formerly Council responsibilities). 

The new rules mean that Upper Hutt City Council's Urban Fire Prevention Bylaw 2005 is now out of date. Council considers it appropriate to continue to have a bylaw that focuses on preventing the nuisance which can arise from fires and smoke.

Council proposes to revoke the Urban Fire Prevention Bylaw and make a new bylaw with a narrower focus. This will be called the Prevention of Nuisance from Fires and Smoke Bylaw. 

Key changes include:
- Removing the powers relating to fire safety and issuing urban fire permits which is now done by FENZ
- Clarify that authorised Council officers can take reasonable steps to reduce the nuisance caused by fire or smoke.
