MLK, Jr. Day of Service - 2023 Registration

* 6. Liability and Photo Release Form

In consideration of my desire to participate in the MLK Day of Service administered by Mobile United, I hereby assume all responsibility for any and all risk of property damage or bodily injury that I may sustain while participating in any voluntary effort, disaster exercise or other activity of any nature, including the use of equipment and facilities of Mobile United. Further, I, for myself and my heirs, executors, administrators and assigns, hereby indemnify, release, waive and hold harmless Mobile United or the ‘Indemnified Party’ of and from any and all claims which I or my heirs, executors, administrators and assigns ever may have against any of the above for, on account of, by reason of or arising in connection with such volunteer efforts or my participation therein, and hereby waive all such claims, demands and causes of action, including but not limited to claims arising out of the negligence or wantonness of the Indemnified Party.

I hereby irrevocably authorize the Indemnified Party to use, publish for advertising, education, trade, or any other lawful purpose whatsoever, original or reproductions of photographic portraits or pictures of me in which I may be included, in whole, in part, in composite, or distorted in character or form, in conjunction with my own or a fictitious name, and made through any medium including, but not limited to the Internet. Such consent is to include any videotapes, films or audio recordings taken of me in conjunction therewith. I hereby consent to the Indemnified Party obtaining a copyright concerning or covering any photograph, portrait, picture, reproduction, or videotape, film or recording of me in its own name and hereby assign all of my right, title, and interest in any rights which I may have to such photographs, portraits, pictures, reproductions, videotapes, films, or recordings or the copyrights thereof unto the Indemnified Party. 

I also hereby waive any right I may have to inspect or approve the finished product or advertising or other copy that may be used in conjunction or connection therewith or the use to which the photograph, portrait, picture, reproduction, videotape, film, or recording may be applied. I hereby release and discharge the Indemnified Party from any liability by virtue of any blurring, distortion, alteration, optical illusion or use in composite form, whether intentional or otherwise, that may occur or be produced in the taking of the photograph, portrait, picture, reproduction, videotape, film, and/or recording or in any processing tending toward the completion of the finished product unless it can be shown that the publication thereof was maliciously caused, produced and published solely for the purpose of subjecting me to conspicuous ridicule, scandal, reproach, scorn, or indignity. Further, I expressly agree that this release is intended to be as broad and inclusive as permitted by the laws of the State of Alabama and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect. I currently have no known physical or mental condition that would impair my capability for full participation as intended or expected of me under either predicted or emergency conditions. I also understand that medical attention may not be readily available.
