Enhancing Your Advocacy Toolbox: Protecting Residents from Nursing Facility-Initiated Discharges

Post-Test

1.If a facility changes the location for discharge on the notice, a new notice must be sent to all parties, but the time-frame of the notice does not start over.
2.If the reason for discharge is "cannot meet the resident's needs" the nursing facility must document what services are available at the new facility to meet the resident's needs.
3.Certified facilities are not required to submit a 30-day notice of discharge to a resident who is being sent to the hospital and is not expected to return to the nursing facility.
4.A certified nursing facility may initiate a transfer or discharge if a resident's family member poses a danger to staff and others.
5.A facility's determination to not readmit a resident from the hospital while a discharge appeal is pending can be due to the resident’s condition when originally transferred to the hospital.
