PRODUCT FEEDBACK TERMS

By clicking “I Accept” below, you are accepting the following terms except to the extent such terms conflict with a pre-existing contract between us, in which case the conflicting terms of that pre-existing contract shall apply.

1. Feedback. You warrant that any feedback you provide to us in the attached survey or any future survey or followup is provided freely, in your sole discretion, and that we are free to use and disclose your feedback for any purpose without an accounting to you or any other person. We own and shall continue to own all right, title, and interest in and to the feedback you provide and the products and services we offer (whether now or in the future) incorporating such feedback.

2. Privacy. We will only use or disclose any personal data that you provide (such as your name, company, or email address) in accordance with our Privacy Policy located at https://wpengine.com/legal/privacy/ and for no other purpose. Our Privacy Policy prohibits us from selling your personal data or using it to market to third parties.

3. Disclaimers. EXCEPT FOR THE WARRANTIES EXPLICITLY PROVIDED HEREIN, EACH PARTY DISCLAIMS ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THOSE RELATED TO ACCURACY, COMPLETENESS, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE.

4. Miscellaneous. These terms may not be amended, nor any obligation waived, except by a writing signed by both parties. In the event any term herein is found by any court to be void or otherwise unenforceable, the remaining terms shall remain valid and enforceable as though such term were absent upon the date of its execution. You shall indemnify us from and against any and all liabilities, obligations, losses, damages, penalties, fines, amounts in interest, and other expenses (including reasonable attorney fees) in connection with a claim or demand brought by a third party related to your breach of the warranties herein, such amounts to be paid by you as they are incurred. These terms are governed by the laws of the State of Texas, without regard to its choice of law statutes, and any disputes must be brought in the state or federal courts located in Travis County, Texas. EACH PARTY WAIVES ANY RIGHT TO JURY TRIAL IN CONNECTION WITH ANY ACTION OR LITIGATION IN ANY WAY RISING OUT OF, OR RELATED TO, THESE TERMS.
